Federal Supreme Court issued on Tuesday, a unanimous interpretation of Article 49 of the Constitution in the light of questions about the number of members of the House of Representatives and provincial councils. The court said in a statement: " The Federal Supreme Court has received an application to the interpretation of Article 49, which reads (the House of Representatives consists of a number of members by one seat per hundred thousand inhabitants of the population of Iraq and represent the entire Iraqi people), in the light of the three questions submitted by the Secretariat General of the Council of Representatives. "
The court added that " the first question attached to the extent of the departure of the will of the legislator to the number (100) thousand for voters or general population , " noting that " the court found by reference to the text of Article (49 / I) of the Constitution, the departure of the will of the legislator to determine the members of the House of Representatives by one deputy representing one hundred thousand people from the hearts of Iraqis , regardless of their personal situation both in terms of age or social positions did not go off and the number of voters. " The court stressed that " the expression contained in the constitutional text (people) came at all and did not allocate the number of voters and the absolute being launched , " indicating that " the second question attached to the constitutional Balmana reduce the House of Representatives seats to 328 seats in the absence of a census" .
The Federal Court stated that " the court found that an increase in the population to the number of representatives in the House of Representatives requires the intervention of legislative provisions of Article (49 / I) of the Constitution , according to the contexts provided for in Article 142 of it and in a form that reduces the current number of seats in the Council."
It noted the court that the "third question dealt with the possibility of the existence of a constitutional objection to limit the number of members of provincial councils between (10 to 25) member," afterthought that " the court found to refer to the provisions of the provincial elections law and district No. (36) for the year 2008 that Article (24) it has identified the members of the provincial council to 25 members with the additions contained therein. "
The court pointed out that "if I want to change that number and addenda between (10 to 25), it requires the intervention of legislative amendment of Article 24 of the law in accordance with the number in question, as the court did not find text in the Constitution precludes a legislative amendment ".
