    Today, Thursday, December 14, 2023, the Federal Supreme Court issued its interpretive decision related to the interpretation of Article (55) of the Constitution of the Republic of Iraq for the year 2005, which stipulates that (the House of Representatives shall elect in its first session a president, then a first deputy. And a second deputy, by an absolute majority of the number of members of the Council, by direct secret election).

    The court stated in a statement received by Al-Sumaria News, that “the interpretation of the above-mentioned article according to the court’s explanatory decision makes it clear that: The vacancy of the position of Speaker of the House of Representatives is treated by the provisions of Article (12/Third) of the internal regulations of the House of Representatives, and that this requires the House of Representatives to convene for the purpose of Opening the door for nominations for the presidency of the House of Representatives to any of its members who wish, and opening the door for nominations to be limited to that session only, in order to resolve the issue of electing the Speaker of the House in a timely manner and not to prolong it. No new nomination may be accepted after the beginning of the voting procedures, and the Speaker of the Council is elected by an absolute majority. In that session or in the following sessions after the first session (from among all the candidates in the first session - with the exception of those who request to withdraw from candidacy), provided that the House of Representatives must continue to perform its duties during the legislative term and its sessions shall be held under the chairmanship of one of the two Vice-Presidents until a new president is elected, and that no “The failure to elect a new president will be a justification for disrupting the work of the House of Representatives.”


     
    She pointed out that “the decision was issued by agreement based on the provisions of Articles (93 and 94) of the Constitution of the Republic of Iraq for the year 2005 and Article (5/second) of the Federal Supreme Court Law No. (30) of 2005 amended by Law No. (25) of 2021, which is final and binding on all authorities.” .

    The Federal Supreme Court in Iraq recently issued a decision to terminate the membership of the Speaker of the House of Representatives, Muhammad al-Halbousi, after a “forgery” lawsuit filed by one of the representatives.

    The Presidency of the House of Representatives also decided, last Tuesday, to postpone the holding of the session to elect a new Speaker of the House to replace the deported Muhammad al-Halbousi until further notice.
