Objections to the merger of legal elections for parliament and provincial councils

Attempts to merge the two laws for the elections of the House of Representatives and the provincial councils met with a number of objections before discussing the proposal with a view to passing it.
Raed al-Maliki, a member of the House of Representatives on the Legal Committee, told Al-Sabah: The election law was presented in the previous session in an expedited manner and included a detour, explaining that the title is to amend the Provincial Councils Law, but in fact it is to cancel the House of Representatives election law and transfer it in accordance with the provisions of the Provincial Law. .
Al-Maliki added that the difference is clear, as the House of Representatives Law for the year 2020 adopts the individual election system, while the Provincial Councils Law adopts the list system, one district, and St. Lego.
Al-Maliki noted that there is a difference in the House of Representatives regarding this matter, as the State Administration Alliance has a political agreement to amend the election law, and as for independent representatives, emerging blocs, Kurdish forces, and some deputies of the coordination framework, they collected the signatures of more than 70 deputies to withdraw the proposal in order to study it and take More space for discussion. Al-Maliki added that the amendment of the election law is within the government program, but we want to put forward a draft for the amendment because the method of presenting the law was for a partisan party that wanted things to proceed according to its opinion without taking the opinion of the rest of the parties, as he put it, explaining that there was no response to the objections by withdrawing the law and discussing it. Rather, the parliament session was postponed in preparation for providing a majority in the next session regarding the law.
Al-Maliki pointed out that the law is supposed to encourage political participation, not to alienate others, especially since we suffer from poor participation.
Last Thursday, the House of Representatives failed to hold its session devoted to discussing several issues, most notably the amendment of the provincial and district council elections law, and decided to postpone its holding until tomorrow, Monday.
Legal expert Ali Al-Tamimi explained that the draft law merging the laws of the provincial elections and the parliament is still in the first reading and is subject to amendment, and it is the parliament that will vote on it and take the necessary steps if there are problems.
Al-Tamimi said, in an interview with "Al-Sabah": The merger of the two laws does not constitute a constitutional violation because the provincial councils that are not organized in a region basically enjoy the local legislative capacity, so it is permissible to combine the two laws and this is in effect in many countries.
