The Khawr Abdullah agreement, which was signed between Iraq and Kuwait more than ten years ago, sparked widespread controversy, especially after Baghdad ceded part of the creek to Kuwait, which necessitated reopening the matter and bringing it to court to decide its fate.
A member of the House of Representatives filed a lawsuit against the agreement with the Federal Supreme Court, amid many hopes that its provisions would be invalidated. In order to preserve the country's economic interests and not allow Kuwait to transgress the country's interests.
Fortunately, the Federal Supreme Court issued a state order standing next to the member of the House of Representatives, Saud Al-Saadi, who submitted the lawsuit, and recognized the invalidity of the Khor Abdullah agreement between Iraq and Kuwait.
The Khawr Abd Allah Agreement, or the regulation of maritime navigation between Iraq and Kuwait, was ratified in Baghdad on November 25, 2013, in implementation of Resolution No. 833 issued by the Security Council in 1993.
Where this agreement led to the division of Khor Abdullah between the two countries, which is located in the far north of the Arabian Gulf between the Iraqi Al-Faw Peninsula and each of the Kuwaiti islands of Bubiyan and Warba, where the navigational corridor located at the meeting point of the navigational channel with the international borders was divided.
Member of the House of Representatives, Saud Al-Saadi, explained the repercussions of the Federal Supreme Court's decision regarding the invalidity of the Khor Abdullah agreement between Iraq and Kuwait after winning the case, while the court's decision was "conclusive and binding" for the internal and external parties.
Al-Saadi said, in an interview with Al-Maalouma Agency, that "the Iraqi government is required to implement the Federal Court's decision to invalidate Law 42 of 2013, which pertains to the ratification of the agreement regulating maritime navigation between Iraq and Kuwait in Khor Abdullah."
And he added, "The federal government has to remove all the effects and repercussions of this agreement and its implementation on Iraqi waters, which is a binding matter," noting that "the agreement included notifying the Kuwaiti side of any Iraqi maintenance work for Khor Abdullah."
The member of the House of Representatives explains, "The court's decision is binding on Iraq internally and even internationally, because it violates international and UN treaties, agreements, and covenants that require that no law or border agreement between two countries conflict with the country's local laws and its constitution."
Al-Saadi, who is the head of the Parliamentary Rights Bloc, states that "the Khor Abdullah agreement has become null and void after the Federal Court's decision," pointing out that "Khor Abdullah returned to Iraq after the last decision."
In turn, the State of Law Coalition considered the decision of the Federal Supreme Court regarding the Khor Abdullah agreement "binding" for all, while indicating that Kuwait has two options.
The leader of the coalition, Haider al-Lami, stated in an interview with Al-Maalouma agency, that "the Federal Court plays a patriarchal role for Iraq in various fields, especially in the political process, such as the issue of oil export, parliament and other important decisions," pointing out that "it was the one with the upper hand through its courageous practices." its important location.
He points out, "The Federal Supreme Court in Iraq, and when it issues a state order, everyone must abide by it, whether it is Kuwait or any other country," noting that "Kuwait, if it has a different opinion, then it must go to international courts."
And the leader of Maliki's coalition continues, "It is the international courts that decide the decision, and Iraq is committed to any decision issued by these courts, as it is the cradle and founder of law."
