    Today, Thursday (March 28, 2024), the academic at the College of Political Science and Law at Diyala University, Khalifa Al-Tamimi, presented the legal view of the Federal Court’s response mechanisms to the accusations against it.
    Al-Tamimi said in an interview with "Baghdad Today", "The Federal Court is concerned with considering issues related to the Iraqi Constitution, meaning that it works according to the terms of reference approved by its law by examining the cases brought before it," adding, "But it does not have the authority to file lawsuits against others, any entities or individuals." ".
    Al-Tamimi added, “Laws emanating from the constitution can be considered in regular courts,” pointing out that “the general course has established mechanisms for the Federal Court and what its powers are, but if the court is subjected to abuse, violations, or false accusations, the public prosecution, which represents the public right, has the right to file lawsuits as Any other person has the right, and this is what happened when his deputy recently filed a case against Deputy Mishaan Al-Jubouri after talking about being threatened by the President of the Federal Court in a televised interview.”
    He pointed out that "the Federal Court includes an important elite of judges who have many years of experience, and its decisions rely on legal mechanisms."
    On Wednesday (March 20, 2024), the Federal Supreme Court confirmed that it was subjected to a “politicized” internal and external media attack targeting its “legitimacy,” while stressing that it would take the necessary legal measures to deter and thwart it.
    The court’s media said in a statement, received by “Baghdad Today”, that “the purpose of the Federal Supreme Court exercising its powers is the correct application of the Constitution, ensuring the unity of Iraq and building a democratic republican, representative, parliamentary system, based on the peaceful transfer of power and fair distribution of wealth, in addition to the foundations Other constitutional principles, for the purpose of building the state in a way that achieves justice, eliminates injustice, preserves public funds and uses them for the benefit of the people, and achieves the rule of law.”
    He added, "This requires that all authorities must adhere to the limits of their constitutional powers, and that local authorities should not exercise the exclusive powers of the federal authorities, because that relates to the sovereignty and unity of the country, with the necessity of local authorities for regions or governorates not organized in a region exercising other powers, and taking into account the common powers between the authorities."     The court’s statement affirmed that, “As a result of its decisions taken to preserve the constitution, the Federal Supreme Court is exposed to an internal and external media attack to discourage it from completing its constitutional duties towards the nation and the people. We believe that this attack is politicized and aims to harm the reputation of the Federal Supreme Court and target its legitimacy.
