Why is it prescribed the criminalization of the Baath Party Law?

proceeded Act (Prohibition Baath entities and racist parties and terrorist Takfiri and activities Party) of the House of Representatives on July 30, 2016, to demonstrate theresources to which it applies the law as well as legal substances that should be implemented to this ban, in addition to the need for courts Iraqi circles for such a law several years ago to deal with members of the outlawed Baath Party , according to theIraqi constitution. That is why The need for this legislation came to the causes of the
following:
1 - should be legislation was in accordance with Article 7 of the Iraqi Constitution.
2 - to ban the Baath Party and prevent him from participating in the political process because it is the party violates the democratic system in Iraq , which is based on political pluralism and peaceful transfer of power.
3 - violations of the Baath Party for the principles and values of human rights in thejustice and morality - of tolerance, freedom, rights and duties, and practice racial and sectarian discrimination, and embraced terrorism.
4 - between the type of practices that prevent Baath Party carried out on the basis of the provisions of Article 4 of the law, which approved the following:
I. It prevents the Baath party from exercising any political activity or cultural or intellectual or social under any name and by any means of communication or the media.
Second: - prevents the formation of any political party entity pursues or adopts racism, terrorism or atonement , or ethnic cleansing or instigation of or glorifies him or promoted or adopt ideas or attitudes inconsistent with the principles of democracy and the peaceful transfer of power.
As for Article 5 of the law Fbmujbha prohibits the Baath Party and its members do business the following:
I. belonging to the Baath Party and under any name whatsoever.
Second force, threat or earn anyone to belong to the Baath Party.
III do any political activity or intellectual would encourage or promote or glorification of the thought of the Baath Party or encouragement to belong to him.
IV participation in general elections or local referendum or a nomination in the general and local elections and the assumption of grades private (Director and above).
V. use the media audio-visual and print to spread the ideas and opinions of the Baath Party.
VI published by the media of all kinds of activities and the thoughts and opinions of theBaath Party.
VII participate in any gatherings or protests or demonstrations.
5 - the law includes sanctions in articles 8, 9, 10, 11, 12 and 13 , which include confinement to certain periods of the Baathists who violate the articles of this law. These materials are needed by the Iraqi judiciary to judge the Baathists, and because of thedelay in approving this law was freed hundreds of Baathists.
6 - indicate the type of sanctions to employees Baathists who distinguish between citizens is invalid, and spreading corruption in their constituencies in all its forms, and they are pressure groups (lobby) to delay the government 's actions and the state and not to complete the project and put obstacles achievements in addition to spying for aforeign and others, spreading fear and disagreement and discord between the citizens and urge the wars and conflicts and create crises in the same country and between countries.
