    The lawyer, Amanj Rahim, presented, on Wednesday, “6 constitutional and legal grounds” for the creation of a new governorate in the Kurdistan region.

    Rahim said, in a clarification followed by “NAS” (March 15, 2023), in which it stated, “The constitutional and legal grounds for considering (Halabja Governorate) in the Republic of Iraq and within the governorates of the Kurdistan Region: –  
      
    ‌1. Halabja Governorate was established by virtue of Kurdistan-Iraq Parliament Resolution No. (11) dated 9/22/1999. And that the Iraqi constitution, in Article 141 of it, stipulates the continuation of the laws that have been legislated in the Kurdistan region since 1992, and puts the decisions taken by the regional government since 1992 into effect.  
      
    ‌2. The establishment of Halabja Governorate was approved by Federal Cabinet Resolution No. (568) on 12/31/2013 taken in the regular session No. (45) as well as Resolution No. 23131 in the regular session of the Federal Council of Ministers No. 11 on 3-13-2023.  
      
    3. The Iraqi Council of Representatives had previously legally recognized (Halabja) as a governorate under the provisions of Article (51) of Federal Law No. (2) of 2015 regarding (the federal general budget of the Republic of Iraq for the fiscal year 2015), and Article (50) of Federal Law No. ( 1) For the year 2016 related to (the general federal budget of the Republic of Iraq for the fiscal year 2016).  
      
    4. The Parliament of Kurdistan-Iraq issued (Law for the Administration of Halabja Governorate in the Kurdistan Region-Iraq No. (1) of 2015).  
      
    ‌5. The governor of Halabja was appointed by a regional decree, and the formations of the governorate administration were completed. General directorates of ministries and agencies not linked to a ministry were created in Halabja governorate, similar to the rest of the other governorates in the region, in addition to the creation of the Treasury Directorate, separating it from the treasury of Sulaymaniyah governorate, and it became financially and administratively independent from Sulaymaniyah governorate. .  
      
    ‌6. The Federal Ministry of the Interior officially approached Halabja as a governorate on several occasions, and this ministry also approved it according to its books numbered (22918) on 4/19/2018, (39672) on 8/6/2018, and (40281) on 8/9/2018. , and (40528) on 9/8/2018, to establish directorates affiliated with the federal government in the Halabja governorate, similar to other governorates, which are the directorates (Passports, Nationality, Information Office) and organizing special car plates in the name of the Halabja governorate according to the Federal Ministry of Interior Book No. (40528) On 9/8/2018.
