Iraq is preparing to close the Kuwaiti compensation file in the first quarter of next year, after paying the last payments of debts, and thus definitively departs from the provisions of Chapter VII of the Charter of the United Nations.
Sources close to the government stated to Al-Mada that "Iraq is close to resolving the compensation file with Kuwait, by paying all the debts that resulted from the practices of the former regime towards this neighboring country."
The sources added, "The complete settlement of the file will take place either in the next February or March, and then the amount that was deducted and given to Kuwait will be provided to the public treasury." For his part, legal expert Tariq Harb said, in a statement to (Al-Mada), that "Iraq's exit from Chapter VII of the Charter of the United Nations was years ago, but what is currently being applied is only related to the payment of debts resulting from the occupation of the former regime of Kuwait." Harb added, "The remaining debts owed by Iraq are very few, ranging from five to four billion dollars." He pointed out, "Iraq does not suffer from any restrictions set by the United Nations, whether at the political or military level, and we can import various types of weapons, unlike the situation before we left Chapter VII."
Harb explained that "the restrictions that were imposed on Iraq under the provisions of Chapter VII at that time prevented it from flying its planes over certain areas of the country, and also prevented it from selling oil." And he stated, "What is left is only the Kuwaiti debt, and the fact that it was issued on the occasion of Iraq's entry into the provisions of Chapter VII, it will continue until it is paid in full." Harb continues, "Getting rid of the debt means that oil imports will be purely for Iraq without deduction, and this deduction was made by a committee at the United Nations and the amount was given to Kuwait."
And he added, "Kuwait's litigation of all its debts would end the work of this committee, and thus we would get rid of an era that lasted for about 32 years."
Harb went on to say that "the Iraqi situation at the international level enjoys complete freedom, whether in terms of import or export to any party or place without the need for approval and notice, and the evidence is that Iraq sells its oil to various countries without restrictions."
For his part, the other legal expert, Amir Al-Daami, said in an interview with Al-Mada that "Iraq's exit from Chapter VII means its liberation from the international restrictions of the United Nations." Al-Daami continued, "Iraq will have the right to recover its seized money and dispose of it according to its vision, as well as contracting on all military and economic levels without referring to the United Nations."
He spoke about the importance of "lifting the international guardianship imposed on Iraq, as it contributes to restoring its international and regional status without oversight or restrictions, which is reflected on its economy and people."
It is noteworthy that international resolutions imposed huge debts on Iraq as a result of the previous regime's occupation of Kuwait in 1990.
