Today, Friday, the head of the Integrity Commission, Judge Haider Hanoun, revealed the most prominent operations carried out by the Commission in combating corruption and recovering wanted persons and smuggled funds, noting that 12 wanted persons were recovered from 6 countries, most of them Arab, during the current year.
Hanoun said, according to the official agency, that “the Integrity Commission worked to recover funds and defendants from abroad through the recovery department,” noting that “the Commission was able to recover many defendants from the United Kingdom and from many countries, including Malaysia, the Emirates, the Sultanate of Oman, the Kingdom of Saudi Arabia, and the Republic of Egypt.” Arabic".
He stated that "the number of defendants who have been recovered during the year 2023 and so far has reached 12 defendants and convicts," stressing that "Hamdiya Al-Jaf and others will be received soon from the UAE."
He pointed out that "the Iraqi Interpol official informed us that the files of the convicts, the accused Raed Johi, in addition to Mashreq Abbas and Ahmed Muhammad Najati, had arrived to America and other countries and were transferred to all countries through the Red Notice, and the completion of all procedures, as he stated that they had reached all countries for publication, as well as the accused." Others are escaped convicts, including Ayham al-Samarrai and other defendants,” noting that “there are 18 dangerous defendants and convicts that we are working to return from America.”
He continued, "The authorities of the Ministry of Justice in America have been handed over the files of 22 to 25 defendants to assist Iraq in arresting and extraditing them," pointing out that "Iraq will complete the procedures for concluding a memorandum of understanding with the American Ministry of Justice regarding combating corruption and extraditing the accused."
He stated that "Iraq demanded, during the speech delivered at the Conference of the States Parties, the tenth session, which was held in America, that there be an international judiciary obligated to hand over the funds with the accused to Iraq, and the establishment of an international court called the International Funds Recovery Court, working on the basis of (Where did you get this?) ), to overcome the obstacles facing Iraq in recovering its money, so when such an international judiciary is held, it will be quick to overcome all obstacles, and the law (Where did you get this from?) will be present so that we can recover our money with ease and convenience.”
He pointed out that "the US Treasury Department was visited on behalf of the Integrity Commission and the Iraq Money Recovery Fund, which is concerned with our money smuggled during the days of the previous regime before 2003, which is a lot of money," explaining that "the visit comes with the aim of helping Iraq recover the smuggled money."
He stressed that "the US Treasury Department was asked to conclude a memorandum of understanding with the Iraq Assets Recovery Fund," pointing out that "the Fund grants many advantages in the event of cooperation, including giving percentages of the smuggled funds to parties that help in returning the smuggled funds before 2003, especially the blockade phase." "Economist, and the oil-for-food-and-medicine memorandum, because of which a lot of money was wasted."
He stated, "The previous regime granted money to Arab and foreign private companies that became unknown after we lost our documents after the period of change and loss of foundations. Many of these figures belonged to the former intelligence service, but they were under private, private, non-governmental names."
He continued, "Approximately 160 million dollars were recovered from the Director General of Relations in the former intelligence service, funds amounting to approximately 26 million US dollars were also recovered from Kuwait, and funds amounting to approximately 20 to 26 million US dollars were recovered from a company that was called Al-Huda Travel and Tourism Company." It was affiliated with the intelligence service, and we are still searching for other funds,” he pointed out, “Money and gold jewelry will be recovered from the family of the former head of the intelligence service, Barzan al-Tikriti, and they are in the treasury of one of the banks in Switzerland, and other funds will also be recovered from figures in the regime.” Previously, the work is underway confidentially, and the funds will be announced as soon as they arrive in Iraq.”
He added: “We worked to besiege the corrupt and recover our money at the international level by concluding bilateral memorandums between many countries. A memorandum of understanding was concluded with the French Republic, under the auspices of the Minister of Foreign Affairs, and a memorandum of understanding was also concluded with the United Arab Emirates, the Arab Republic of Egypt, Russia and Palestine. A memorandum of understanding will be concluded with the Hashemite Kingdom of Jordan, the Republic of Lebanon, Brazil, and Algeria in Iraq during next January, and a memorandum will also be concluded with the Kingdom of Saudi Arabia in Riyadh and with China soon.”
He stressed that "contracting memorandums aims to provide legal assistance in recovering funds, given that there is no obligation for countries to return funds even if there are international agreements, whether at the level of the United Nations Convention against Corruption, the Arab Convention against Corruption, or the agreement named after Jeddah or Mecca, which It concerns the Organization of Islamic Cooperation, which includes 57 countries, but it does not bind the countries, and only provides a framework for cooperation,” explaining that “bilateral agreements or bilateral memorandums of understanding are also not obligatory, but semi-binding, that is, it is a cooperation agreement between the two countries.”
He stated, "There is no obligation on countries in this field at all. Rather, they are the origins of understandings and commonalities between countries. However, we seek through them to conclude memorandums of understanding based on the basis of common interests and mutual respect."
Hanoun stated, “The file of dual nationalities is one of the reasons for our request, for there to be a binding international judiciary, but the problem is the difference in national systems in each country, so dual nationals sometimes obtain the protection of that country based on its national laws,” pointing out: We seek, through memorandums of understanding, to restore dual citizenship.”
He pointed out that “when an Iraqi citizen is granted another citizenship from any country, he takes an oath in the sense of an oath of loyalty to that country, which absolutely contradicts the interests of Iraq. That is, if the interests of that country from which he obtained citizenship conflict with the interest of the homeland, then this oath advances the interests of that country.” The state over the interests of his motherland,” stressing “the necessity of reading the oath to that state carefully. If we find in the oath something that indicates that it absolutely contradicts the interests of Iraq and advances the interests of that state whose acquired citizenship the citizen obtained, then here we must refrain from giving him any public responsibility.” Because otherwise, we will hand over the interests of Iraq to that country.”
He explained, "This oath and acquired nationality are one of the main inconveniences and obstacles to Iraq's efforts to recover the accused and the money, because it has money and accounts in that country," pointing out that "at the next Conference of States Parties, which will be held in the State of Qatar, we will present an integrated project for binding international judiciary."
He stated, “With this binding judiciary and the international court that obliges states, if the accused who stole our money belongs to them by acquired nationality, then they must hand over that money to us by relying on the principle of (Where did you get this from?), where we go to his accounts before he comes to Iraq and steals.” “Our original money is in that country,” explaining, “We are serious about establishing this international law.”
He pointed out that "there are ministers in the previous government and the current government who are under investigation, but what distinguished the current government is represented by the position of Prime Minister Muhammad Shiaa Al-Sudani, as he told us that there are no obstacles before you or red lines for investigating my government or my advisors, and he was a great supporter." "For us," stressing that "the Prime Minister opened the anti-corruption file, and he is honest and serious about obtaining fruitful results."
