    The Commission added that sending UNHCR employees to other countries, in light of the critical health conditions, represented by the spread of the Corona pandemic, endangers their safety, which was explained by the General Secretariat of the Council of Ministers in accordance with the decision of the Supreme Health and Safety Committee No. (11) for the year 2021 ″.
    The truth is that the Commission's decision; It has the reasonable justifications for its issuance, but it collides with an important legal obstacle, which is that the Electoral Commission had to go to the House of Representatives to support its decision by law, as it has no jurisdiction over the votes of Iraqis, and it has no right under any justification to deny them their constitutional right, or cancel Elections wholly or partly, even if its decisions have the force of law, this is absolutely not superior to the constitution, and it is the strongest guarantor of the citizen’s right to elect a representative, in addition to the fact that the duties and decisions of the Commission relate to organizational matters and not to the origin of the electoral process.
    The failure to conduct an external voting process, and the reasons provided by the Electoral Commission; Because of its decision, which lacks legal basis, confirms what we went to, that the elections for next October will not take place on time, after they were postponed for the second time, even though they are early elections, and between the postponement and the postponement of six months, that is, the total of the two postponements was a full year, especially since the reasons The one that the commission brought to cancel the voting of Iraqis abroad will remain in place for a long time, as no one knows when the Corona pandemic will end, and the commission can easily use the same reasons and excuses to postpone the elections for the third time, and perhaps for the tenth time ?!
    A note that reinforces this conviction is that the government's efforts to combat the pandemic are not satisfactory, and to date a large vaccination program has not started, and it is not expected to start it soon, in addition to the lack of transparency of the issue of providing the vaccine, as there is no clear and publicized information on purchase contracts The vaccine and its preparation dates.
