    {Local: Al Furat News} The Federal Integrity Commission revealed the issuance of a judgment of severe imprisonment against a retired judge in accordance with the provisions of Article (19 / Second) of the Integrity and Graft Commission Law No. (30 of 2011) amended in a precedent which is the first in which the Iraqi judiciary is issued Judgingly, based on the Authority’s amended law that was repealed in Article (10) of the amendment (Illicit Gain at the Account of the People Law No. 15 of 1958).
    The commission, while talking about the details of the case it investigated and referred to the judiciary, stated that the Al-Karkh Criminal Court / Third Commission issued a decision to convict a retired judge; Due to a large increase in his wife's money, and his inability to prove the legality of that increase, indicating the registration of (24) shares, which make up three quarters of the shares of a real estate in Baghdad in the name of the convicted wife, at an amount of (17,250,000) million dollars.
    She added that the court had seen the evidence obtained in the case represented by the book of the Integrity Commission - Department of Prevention, which included a scanned copy of all the priorities of the convicted person. Which prove the existence of inflation in the funds that appeared as a result of tracking the investigation teams of the department; As the debtor did not mention in the financial disclosure form that he, his wife or his children possessed the amount with which the shares of the property were purchased.
    She explained that the ruling included the return of the value of the 24 shares of the property belonging to the wife of the convicted person, which represents the value of the illicit gain of $ 17,250,000 in implementation of the provisions of Article (19 / Fourth) of the Commission’s Law, as stated in the decision issued as an inference. According to the provisions of Article (132/3) of the Penal Code No. (111 of 1969) amending a fine of (10,000,000) millions of dinars against the convicted person, and in the event of non-payment of simple imprisonment, which shall be executed consecutively after the end of the original penalty.
    It is noteworthy that Article (19 / fourth) of the Federal Integrity and Illicit Gain Law No. (30 of 2011), as amended, stipulated: (The court shall rule to refund the value of the illicit gain, and those convicted according to Clauses (Second) and (Third) of this article are not released except after Paying the amount of the fine and returning the value of the illicit gain, and the lapse of the penal lawsuit with death does not preclude the implementation of the judgment to refund the value of the graft).
