    Shafaq News/ The concerned authorities confirm the importance of the Workers’ Retirement and Social Security Law No. (18) of 2023, as it expands its coverage of the various segments of society working in the private sector (organized and unorganized), in addition to its inclusion of many privileges, some of which “almost exceed” what is obtained.     The Iraqi Prime Minister, Muhammad Shiaa Al-Sudani, announced last Sunday that the retirement and social security law for workers in the private sector had entered into force, after the Iraqi Parliament voted on it last May, in a step that the government described as essential within the economic reforms it promised. And ensuring the rights of workers in this sector.
    Expanding the umbrella of inclusion
    In this context, the Director of the Media Center at the Ministry of Labor and Social Affairs, Najm Al-Uqabi, says, “The new Retirement and Social Security Law has many privileges, including expanding the umbrella of coverage by the provisions of this law, by adding an optional security clause and guaranteeing workers in unorganized work, that is, even The owner of (Bastiyya) and (Taktuk) can enter the social security umbrella.”
    Al-Aqabi added to Shafaq News Agency, “Among the privileges of this law is the addition of labor service to the government sector for the purposes of bonuses, promotions, and retirement, and the inclusion of a retirement equation that guarantees a retirement salary that provides psychological and material stability for those covered by the provisions of this law, and is equal to the retirement equation for employees in the public sector, and some of the privileges are almost It exceeds the benefits that a worker receives in the public sector.”
    Among other privileges, it is mentioned that “the state supports workers covered by social security with 8 percent of the wages and allowances of workers in the organized sector, and 15 percent of the wages of workers in the unorganized sector, which contributes to the financial sustainability of pensions and the sustainability of the fund.”
    He continues, “The law also took into account employers, not just the worker, as it allowed employers to renew subscriptions for a period of 90 days instead of 30 days, while stopping late fines with a ceiling of 200 percent instead of continuing them without stopping.”
    He added, "In addition to the privilege of purchasing a service, that is, a worker who does not have a service that qualifies him to receive a retirement salary can purchase a service that does not exceed 5 years, in addition to the possibility of returning the end-of-service gratuity amounts that the worker has previously benefited from so that he is included back in the guarantee and the service is counted for retirement purposes."
    He continued, "Among the law's privileges are also granting annual cost-of-living allowances and linking them to inflation, and reducing the percentage of disability pension entitlement from 35 percent to 30 percent, in addition to adding the unemployment insurance branch, that is, the department grants a salary to the worker who became unemployed due to a reason outside his work." "His will."
    He added, “As well as providing health insurance for workers in retirement with reliable insurance companies in coordination with the Ministry of Health to provide health services for all insured workers,” stressing that “the law is also fair to working women in terms of pregnancy and maternity leave, which is paid with a full salary, and the work will be electronic automation for all aspects of the department’s work.” And within a period not exceeding one year from the date of entry into force of the law.”
    Other details about the law
    For his part, a member of the Parliamentary Labor and Social Affairs Committee, Amir Al-Mamouri, points out that “the Security Law provides job grades for many workers in the private sector, and it contains many privileges that will support the private sector and its employees and workers, including the transfer of service between the private and public sectors.” For the purpose of bonuses, promotions and retirement, the retirement age starts from 50 years and upwards.”  
    Al-Maamouri continues his speech to Shafaq News Agency, “The law guarantees the worker, when he is injured by 30 percent or more, a partial retirement salary, and if his injury is total, he is given a full retirement salary, and this retirement salary (partial or total) is inherited to the heirs.” 
    He adds, “For example, if someone had 15 years of service in the private sector, and stopped working due to not finding another job opportunity and then died, his family would not have obtained rights previously, but in this law, since he has completed 15 years, the His family has a pension, and whoever guarantees himself under this law, his family will have a pension if he dies, regardless of age and service, even if his service was only two months.”
    He explained, “This includes the private, joint, and mixed sectors, as long as the worker is guaranteed in the retirement and social security funds. However, in the past, only those who work in the organized sector were included, meaning those who are under the umbrella of a company, factory, or factory, but in this law all Whoever works in the private sector, whether organized or unorganized, and “unorganized” means all owners of crafts and professions, members of unions, and others. It includes all subscribers to this fund.”
    He stated, “The retirement salary is a condition that it is not less than the average wage, which is 350 thousand dinars at the present time, but in the future there is a tendency to increase workers’ salaries and the average wage to be from 400 to 450 thousand dinars, and thus the retirement salary will not be less than 400 to 450 thousand dinars.” Dinar". 
    He continued, “For everyone who has previously departed from the Workers’ Security Retirement Law, the retirement salary is not less than 500 thousand dinars, and whoever has an injustice can submit a request to the Board of Directors for redress, and the retirement salary will be calculated for him over the last 5 years, at the rate of 80 percent, that is, whoever has Full service and his pension, for example, is one million dinars. He will leave with a pension of 800 thousand dinars.” 
    Fears of routine 
    In turn, the legal expert, Ali Al-Tamimi, says, “Law No. 18 of 2023, the subject of discussion, consists of 109 articles, and it is one of the important laws, as it clarified the shape of the economic system in Iraq after it was gelatinous, and the reasons for the legislation talked about an expansion in the inclusion of segments.” Which was not in the previous law.
    Al-Tamimi added to Shafaq News Agency, “But there is a need to dissolve the routine that may arise when applying the law in the departments of the Ministry of Labor and Social Affairs, because this law established a body with branches in the governorates and a fund, and this fund is financed by subscriptions and investments.”
    He continued, "Every person from the different segments of society covered by the law will have a file and a file in Baghdad or the governorates as a means of monitoring him and paying the pension contributions at a rate of 2.5 percent of what he receives, and after that he will have the pension salary."
