The Federal Court’s decision to stop the transfer of funds from the central government to the Kurdistan region introduced the relationship between the State Administration Coalition and its ally the Kurdistan Democratic Party into a tunnel that may disturb the positive atmosphere that prevailed recently between the federal government and Erbil, which recently sent several delegations to Baghdad to reach an understanding on many outstanding issues, including share Territory in the budget.
The federal decision shocked many political circles who believed that the political agreement to form the government would pass the region's funds peacefully, like its predecessor, but the court confirmed that the decisions issued by the Council of Ministers in 2021 and 2022 regarding the transfer of funds to the Kurdistan region were incorrect.
A statement quoted the President of the Federal Supreme Court, Jassim Abboud, as saying, “The 2021 budget obligated the settlement of financial dues between Baghdad and Erbil since 2004, and that the decision aims to build the state and prevent violating the constitution.”

The statement added, "The Council of Ministers cannot take decisions contrary to the general budget law, and that the request to delay the settlement of the lawsuit or to settle it in violation of the constitution and the law represents a violation of all judicial principles."
The leader of the Kurdistan Democratic Party, Mahdi Al-Faili, said: “The decision does not only harm the people of the region, but rather all the Iraqi people because it affects the approval of the budget,” noting that “the parties that pushed for this law are the same ones that pushed for raising the exchange rates of the dollar.” .
And Al-Faili indicated, in an interview with Al-Sabah, that “the decisions of the Federal Court are final and binding, and their implementation cannot be reversed,” adding that his party “awaits the steps of the government and the political blocs with which it was agreed to pass the budget law, and we are also waiting for the decision of the central leadership of the region.”
The head of the Kurdistan Democratic Party, Masoud Barzani, considered the Federal Court's decision "hostile" towards the people of the Kurdistan region, pointing out that securing part of the region's dues is one of the terms of the political agreement on which the government was formed.
For his part, the representative of the Democratic Bloc, Sharif Suleiman, counted the decision as "having a political aspect and cutting off the livelihoods of the people of the region," adding that the Democrat "will not boycott the political process in Iraq until now because of his belief in the possibility of a solution through dialogue."
While a member of the State of Law coalition, Wael Al-Rikabi, said, in an interview with “Al-Sabah”: “Everyone is committed to the decisions of the Federal Court, and that the judicial decision is one thing and the political disavowal is another, and whatever its impact on any political bloc, it does not affect the political side with the partners.”

Al-Rikabi added that “the Kurdish position may be media based on rights, but it does not mean that it came as a result of political pressure,” stressing that “the language of dialogue and understanding is the most general, and there is a need to pass the budget law quickly or agree on approving the oil and gas law to overcome obstacles and problems between Region and centre.
In turn, the leader of the Kurdistan Union, Ghiath Surji, indicated that it is clear to everyone that there are two Kurdish members among the members of the Federal Court, and they are candidates from the Democratic Party and the Union, and they are among the voters for the decision.
Surji said, in an interview with "Al-Sabah": "There are signs of a solution to the knot, despite the inappropriate timing of the decision," noting that "there is a clear rapprochement between the center and the region, and we fear that this decision will destabilize this convergence."
He added, "The amount of 200 billion dinars is aid to the region's employees and retirees, and this should not be mixed with political matters and their disputes."
The leader in the coordination framework, Turki Al-Atbi, said: “The Federal Court’s decision that decided the file of exporting oil from the Kurdistan region without going through Baghdad was not political and adopted clear constitutional mechanisms and controls,” pointing out that “from 6-7 Kurdish political forces and currents supported the decision.” ».
Al-Atbi added, in a press statement, that "the failure of the regional government to interact with the decision of the Federal Court will lead to a crisis," pointing out that "the export of oil must be managed by the Federal Ministry of Oil exclusively in accordance with the constitution, because the file contains great ambiguity."
