[rtl]Baghdad / NINA / - The head of the Iraqi Journalists Syndicate, President of the Union of Arab Journalists, Moayad Al-Lami, confirmed that the draft law on freedom of expression, assembly, and peaceful demonstration has a significant regression and does not comply with international standards, even after the amendments.
Al-Lami said, during the public hearing session, which was held by the parliamentary human rights, culture, media and legal committees on the draft law "Freedom of expression, assembly and peaceful demonstration", today, Sunday, in the presence of the First Deputy Speaker of Parliament Mohsen Al-Mandalawi, Head of the Iraqi Media Network Nabil Jassem, activists and representatives of civil organizations concerned with human rights, that "the law in its current form is contrary to Article 38 of the Constitution, and the legislator did not request that this be regulated by law," pointing out that "paragraph 3 of Article 38 talked about freedom of assembly and peaceful demonstration, and this is regulated by law, which is the first constitutional violation."
He added, "The freedom of opinion and expression for all means is not absolute, leaving things contrary to the judiciary, and even public morals are not meant by absolute morals, and we have the judiciary, the penal code, and clear constitutional articles, because the expression of opinion is guaranteed to everyone.
And he explained, "This is the first reservation because the law spoke about freedom of assembly and peaceful demonstration only, and it regulates that by law, as we discussed this with parliamentary committees since 2011 and 2012, and it is repeated again in the form of the right to information and information crimes, and the same law is being repeated now, which means that we are turning the wheel back.” .
He went on to say, "Freedom of expression is a constitutional right, and many neighboring countries have stipulated that the state guarantees freedom of expression, and that the citizen expresses his opinion in writing and other means of expression, provided that it does not exceed the limits of the valid legislated laws, whether in the Iraqi state or any other country.”
The Iraqi Journalists Syndicate affirmed, "Freedom of opinion and expression is always mentioned in one wording in all legislation, but the draft neglected the text on freedom of expression, which is the basis and essence of freedom of expression. Therefore, we suggest rephrasing the text on freedom of opinion and expression.”
Al-Lami went on to say, "The most important manifestation of freedom of opinion and expression is freedom of the press, and it must be included in the draft law and be a clear text."
He said that Article 19 of the Universal Declaration of Human Rights in 1948 stipulates that everyone has the right to enjoy freedom of opinion and expression, and this right includes freedom to embrace opinions without harassment and to seek, receive and impart news and opinions to others by any means without regard to borders, as well as Article 38 of the International Covenant Document The Civil and Political Rights of the United Nations in 1966 stipulates that every person has the right to embrace opinions without harassment and freedom of expression for every person, and This right includes the freedom to seek, receive and impart information and ideas in various circumstances and regardless of borders, knowing that Iraq has approved the Universal Declaration of Human Rights and ratified the International Covenant on Rights in Law No.193 of 1970 was ratified in the Iraqi Gazette in 1970, which means that these two international documents have legal force in Iraq and are related to internal legislation that is still in force and binding on the authorities and courts.
The Syndicate of Journalists reaffirmed that "the draft has a major regression and does not comply with international standards, even after amendments."
He went on to say that "international legislation places access to information in an independent and individual legislation that is not within a group of ideas, and therefore we support the issuance of independent legislation for the right to access information."
He added, "The right to hold public meetings is a constitutional right, but it is regulated by law and so far there is no law in this regard, as it is supposed to talk now about the law of freedom of access to information, as as well as the freedom of assembly and peaceful demonstration that is regulated by law.”/ End
