According to the Iraqi network of investigative journalism Nerej, more than 300,000 innocent detainees were placed in Iraqi prisons during the years 2014-2015-2016, most of whom were arrested on sectarian grounds.

According to an investigation conducted by the network with official and judicial sources, "the law stipulates that the security formations must file the files of the detainees within 24 hours from the date of arrest, but this does not happen on the ground. On the contrary, even judicial decisions to release the detainees Innocent people are late implementation, pointing out that this time deliberately created by corrupt officers in preparation for extortion.

The investigation added that "with regard to the shortcomings recorded in the method of administration of prisons in Iraq, the network's realization that it is the multiplicity of departments of prison institutions, some linked to the Ministry of Justice and the Ministry of Labor and Social Affairs in addition to the existence of the Department of the Ministries of Defense and Interior and intelligence services have their own prisons, It is difficult to find a comprehensive census of the number of detainees, as these institutions do not reveal accurate statistics at all. "

The investigation revealed that, "after tracking the electronic archive of the judicial authority in Iraq over a period of 3 years (2014-2015-2016) and a large collection of statistics and disaggregated data, most recently a census published in December 2016, the official data that were surveyed That the Iraqi judiciary issued a decision to acquit (76415) detainees, including (8418) were charged with terrorism, an average of (6368) of the detention per month and (212) per day, and the month of June of 2016 highest rate of acquittal (10791), including (1608) accused of terrorism, followed by the month of May and reached (10373) of whom (3456) accused

The report added that "in 2015, the statistics indicated that the judiciary has approved the acquittal of (88297) people from January to December, including (10124) accused of terrorism, the rate of (7358) arrests per month, and (245) arrests per day, and the month of September of 2015 recorded the highest rate of acquittal of detainees, the number (9480), followed by the month of December (9268), the figures did not clarify the numbers of those accused of terrorism, The elimination of the publication of these details in some periods. "

"The Supreme Judicial Council announced during the annual information conference of the members of the judiciary about the acquittal of (150158) detainees, including (8957) accused of terrorism, which is greater than the number of innocent detainees in 2015 and 2016, at a monthly rate (12513) ) Was detained innocent, where the investigation revealed that the attack launched by the organization in June 2014 and the chaos that followed the country were behind the rise of the proportion of "innocent detainees" that year.

Collecting these statistics, 31,470 innocent people were wrongly arrested over the three years, at a rate of 8,996 detainees per month, 300 per day, 12 persons per hour, and one person every 5 minutes, Or criminal offense.

According to an investigation by the Iraqi Network for Investigative Journalism, "the number of innocent prisoners reveals a real problem in the security and investigative system in Iraq, according to experts, where thousands of arbitrary arrests are carried out to counter the escalation of violence. These arrests create problems in the community peace and lead to differences between the political forces" .

"The statistics do not include arrests in prisons belonging to some popular factions that were founded in the summer of 2014," said a former deputy from Anbar province, that the militia, "Hezbollah" has arrested 3,000 residents of Anbar in stages since the start of the battle to restore the city of Fallujah Of the Mayors in May 2016, asserting that their fate is still unknown. "

According to the data obtained by the network, which is stamped with the seals of the Supreme Judicial Council, "(27499) persons were arrested by the police under Article 4 of the Anti-Terrorism Act specifically, over the years (2014-2015-2016) and later found to be innocent after they faced punishment The majority of whom are from the governorates of central and western Iraq. Political and clan leaders from these governorates have used the term "four years" in reference to the fact that article 4 targets only the Sunni component. This article is based on the Anti-Terrorism Law No. 13 of 2005, Provides for the death penalty "for anyone who has committed as an original actor

On the other hand, a former deputy in the parliament said in a press statement that "there are bargains between the police and the prisoners' families to pay money for the release of their children from prisons, and the manner in which the bargaining was arranged, adding that" the process is conducted through lawyers who follow the case papers, Money can not get out of prison, despite his innocence, "pointing out that the current pricing for the release of innocent detainees, vary according to the type of charge, the charge of terrorism is the highest among the charges and the amount of two hundred or 300 thousand dollars followed by theft.

The investigation points out that "for similarity of names, the wrong arrests are also due to the similarity of names, a common phenomenon inside Iraq. The names of familiar persons are numerous and derived from the religious and tribal heritage. The country has witnessed hundreds of arrests of persons wanted for justice, The wrong person, where the detachments at the checkpoints deployed at the entrances of the Iraqi provinces and neighborhoods computers devices include lists wanted to judge on terrorist or criminal charges obtained from the Iraqi judiciary, but the problem that the lists include the name of the wanted and his father While his grandfather is rare, with the charge and the court that demands it, without including any other information such as the mother's name, title, character or personal image. "

"The indiscriminate arrests of people who are later found to be innocent are not only obtained through sudden raids by the police forces into areas considered by them to be classified as hot and incubator for terrorists, but to information obtained by the so-called secret informant, To the Code of Criminal Procedure No. 23 of 1971 amended, and the Council of Ministers in March 2013, the abolition of its work after protests in the provinces inhabited by a majority Sunni.

"In the midst of a spiral of security crises and political conflicts in the country, and the decade of corruption and extortion in the face of the disruption of security procedures and the inability of judicial proceedings, thousands of innocent people are still in detention centers and prisons pending the resolution of their situation."
