The Parliamentary Legal Committee ruled out that the law replacing custodial sentences in exchange for sums of money would be passed or that it would be given a first reading for many reasons, the most prominent of which is that the law would be an alternative to the amnesty law if it is passed, and it would also cancel the punishment for the prisoner. Committee member, Muhammad Jassim Al-Khafaji, said in an interview with “Al-Sabah”: Negative punishment means imprisonment and limits the individual’s freedom, and it is called that according to the law, and this law includes the punishment of imprisonment only. This law, according to the proposal previously received from the Supreme Judicial Council, includes imprisonment for a period of three years. Years and less, which also includes conditions, such that he pays a fine for every remaining day of his sentence, such as two years, for example. He added that the draft law requires that it be the fullest part of his sentence and does not include all punishments, but rather the punishments committed before its enactment, indicating that the law stipulates that the convict pay a financial sum for each day, and the amount proposed in the law is 10 thousand dinars, which is an amount that is considered inaccurate and needs to be repeated. Al-Khafaji stated that the proposed law has not been read yet, and there are objections to it, including that it denies the nature of punishment, while other objectors believed that it would be an alternative to the Amnesty Law, and by legislating it, we would not need to legislate the Amnesty Law, and the latter is more comprehensive, noting that it is unlikely at the present time to read it.
