A complaint filed by an Iraqi woman about the marriage of her 12-year-old daughter by her father, and her request to the authorities to intervene, opened the door once again to the [You must be registered and logged in to see this link.] in Iraqi society, which this time extended to include cities after it was common in rural areas, villages and [You must be registered and logged in to see this link.].
A woman appeared on social media, pleading with people to save her 12-year-old daughter from her father, who decided to marry her off to his second wife's brother in an illegal, customary marriage contract, which sparked a wide wave of interaction that prompted activists to organize a campaign to pressure the authorities to act.
However, a statement by the Community Police Directorate within the Ministry of Interior said, “The Community Police has found the truth of a video clip of a woman in which she said that her ex-husband and the father of her 12-year-old daughter had forcibly married her outside the court and without her consent.”
The statement added that "a work team was formed to find out the truth of what was stated in the video, and the girl, her father, her husband and her brother were met, and she confirmed that the marriage had taken place with her consent, and she is happy with it."
The statement spoke of informing the police of the "Shari'a contract", according to which the underage girl was married, and added that "Shari'a and the law permit the marriage of a minor by proxy of her guardian."
The statement of the Ministry of Interior carried what jurists considered many inaccuracies regarding the issue by talking about the marriage of a minor with her consent and happiness with her husband, as Iraqi law does not allow marriage before the age of fifteen in the first place, and those above this age require the conviction of the judge and the consent of both parents and the girl.
According to figures from the Iraqi Ministry of Justice in Baghdad, the majority of underage marriages take place outside the court within what is known as “the Arab contract,” meaning a marriage contract that takes place outside the court by an authorized person, who is usually a mosque sheikh or a cleric in the village or region.
The cases of underage marriage increased, according to sources within the same ministry, to about 50 percent of what it was in 2011, which resulted in a rise in divorce cases, as well as domestic violence and an increase in suicide rates.
An official in the ministry described the high rates of underage marriage within Iraqi society as shameful, stressing that “there is a need for concerted efforts with ministries and civil society organizations to raise awareness about the seriousness of this phenomenon, especially for marriages that are carried out for economic motives or without the girl’s consent or convincing her of a reality other than the reality of marriage.” and his responsibility.”
Following the statement, activists launched wide criticism of the Ministry of the Interior, considering her behavior illegal, after her allegations that the marriage took place with the consent of her father, asking about the girl herself and her position.
Social researcher Zahraa Al-Saadi asserts that “divorce cases and their increase did not come from a vacuum. Rather, there are clan, social and economic reasons that pushed towards increasing the marriage of minors, as the difficult living situation and the increase in unemployment of the head of the family push him to marry off his underage daughters in exchange for certain sums of money, and this led to the disintegration families and an early increase in divorce cases.
Al-Saadi added, speaking that the clan tendency was the reason behind this increase, as some Iraqi cities witnessed a significant increase in the marriage of minors through what is known as gifts or clan separation, and thus the absence of judicial oversight and its non-interference resulted in a noticeable increase in the number of underage marriages.
In turn, legal expert Ali Al-Tamimi considers that “the first paragraph of the Iraqi Personal Status Law defines marriage with the eligibility of both parties, and eligibility requires that the age of the applicant for marriage be 18 years and over, and there are exceptions if the court makes sure that the applicant for marriage at the age of 15 is physically and psychologically capable, so his marriage can be registered Officially, with the consent of the father. As for the conditions of marriage in Article 7 of the Personal Status Law, they are complete capacity, reason, puberty, and consent between the two parties.

Abu Moayyad, one of those who married off their underage daughters, and married one of his daughters at the age of 15, talks about his experience, which he justifies by financial poverty, describing it as a “fatal mistake.” He added, "My daughter suffered from compelling health and psychological problems that eventually led to her divorce two years after her marriage, and I deeply regret the harm I caused her."
Abu Moayyad says, adding, “Thank God that she did not give birth, otherwise the tragedy would have been doubled, and I advise parents, whatever their circumstances, not to take these steps that will negatively affect the lives of their daughters, especially since we suffer from a social and economic crisis that hit most classes of Iraqi society, especially in poor governorates.” ', as he put it.
