The House of Representatives is scheduled to discuss a new law proposal submitted by a representative of the Legal Committee that requires replacing custodial penalties with financial sums.
According to a member of the Parliamentary Legal Committee, Raed Al-Maliki, the Presidency of the House of Representatives approved the proposal and included it on the agenda.
Al-Maliki explained, in an interview with Al-Sabah, followed by Mawazine News, that the proposed law includes granting those sentenced to three years’ imprisonment the right to request that the remainder of their sentence be replaced with a sum of money as a fine, estimated at ten thousand dinars for each day, noting that the convict will be Convicted of minor crimes, with the condition of waiver from the holders of personal rights, while those previously covered by the amnesty law, and those convicted of drug trafficking crimes, corruption and other crimes were excluded.
For his part, legal expert Dr. Walid Al-Zaidi praised this procedure, considering it to be the practice in many countries of the world.
Al-Zaidi added that some laws indicate the need for the convict to have good behavior for the purpose of his conditional release, with more than two-thirds of the period, and he can also pay amounts for the remaining period.
He pointed out that there are specific cases in the law, and they were applied before 2003 in Iraq, stressing that some articles of the Iraqi law are taken from European contexts, and many of them include this procedure, warning that there are conditions that prevent the release of criminals, and the exception of those previously covered by the amnesty law.
