(Baghdad: Euphrates News) An expert in the Constitutional Affairs warned of the circumvention of political blocs on non-Muslim components (minorities) to give their representatives seats of jurists in the Federal Supreme Court, pointing out that the draft currently before the House of Representatives does not give them the right to vote, stressing that prevail Clerics will have to make decisions and judgments.
The expert Mohammed Sharif in a statement received (Euphrates News) a copy of it, that "political blocs wishing to dominate the Iraqi judiciary put forward a controversial proposal, for what it considered an attempt to reach a final version of the Federal Supreme Court law."
Sharif added, "The proposal includes granting representatives of Christians and Sabean Mandaeans seats of jurists in the Federal Supreme Court under the pretext of satisfying them after feeling these components of exclusion."
He pointed out that this proposal is very dangerous and constitutes a circumvention of the non-Muslim components. They will be preferred over the judges. "
Sharif said that "the role of legal experts will be in addition to that it is advisory, it is confined to issues relating to the principles of human rights and democracy, and the number of only two compared to four members of the clergy."
"The Islamic Sharia scholars who are candidates from the Sunni and Shia waqfs who have the right to vote in court will prevail, and any verdict can only be issued with the approval of three quarters if it is related to Islamic law," he said.
"This trend reflects the consecration of religious and ethnic exclusion created by the draft law of the Federal Supreme Court."
In his view, "resolving the controversy in this regard is the proper application of Article (92), paragraphs of the Constitution, which is to keep the body by its judicial nature of any of the judges exclusively."
Sharif stressed, "respect for the privacy of the independence of the Federal Supreme Court and non-interference in its functions, and make experts and jurists within the circle of advisors to submit technical reports to non-binding judges, and from all segments of Iraqi society, as applied by judicial norms."
He stated, "The law that the Court is working in the current conforms to the Constitution and meets the requirements of the current stage, but the argument of the political blocs the need for a new law comes to dominate the judiciary."
He continued, "to continue to seek these blocs to ensure the nomination of all members of the Federal Supreme Court, whether judges or experts of Islamic law (clerics) or jurists of law to be all belonging to political parties, as is the case of independent bodies."

Warnings of circumvention of minorities in Iraq controversial law

    2019/08/28 01:25:59

An expert in the constitutional affairs warned against circumventing political blocs on non-Muslim components (minorities) by giving their representatives seats of jurists in the Federal Supreme Court, while the draft currently before the House of Representatives does not give them the right to vote, he saw that the clergy will prevail in issuing Decisions and judgments.
The expert Mohammed Sharif, "the political blocs wishing to dominate the Iraqi judiciary put forward a controversial proposal, for what it considered an attempt to reach a final version of the law of the Federal Supreme Court."
He added that "the proposal includes granting representatives of Christians and Sabean Mandaeans seats of jurists in the Federal Supreme Court on the pretext of satisfaction after feeling these components of exclusion."
Sharif pointed out that this proposal is very dangerous and constitutes a circumvention of the non-Muslim components, pointing out that the role of jurists in accordance with the minutes of the session of the House of Representatives dated (30/6/2019), will be advisory and have no right to vote, unlike jurists of Islamic law Who will be preferred over judges. "
He added that "the role of legal experts will be in addition to that it is advisory, it is confined to issues related to the principles of human rights and democracy, and the number of only two compared to four members of the clergy."
He stated, "The law that the Court is working at the moment conforms to the Constitution and meets the requirements of the current stage, but the argument of the political blocs the need for a new law comes to dominate the judiciary."
Sharif went on to "continue to seek these blocs to ensure the nomination of all members of the Federal Supreme Court, whether judges or experts of Islamic law (clerics) or jurists of law to be all belonging to political parties, as is the case of independent bodies."
The Iraqi parliament last June discussed the draft law of the Federal Supreme Court and is scheduled to submit its final version, which can be read in future sessions.
Partisan parties in Iraq are seeking to impose their authority on the judiciary, and the Federal Court has not been spared from those influential parties, which are pushing to approve the law of this court according to their interests.
Although this move towards the judiciary is being pushed towards them under the slogan "religious jurisprudence", but its motives and motives remain political, it is an attempt to subjugate the judiciary under the name of "religion", so that this authority in the hands of religious lawmakers, who have influence to pass and disrupt the decision .
