A statement of Parliament, received by (Al-Mada), stated that the new legislative term for Parliament begins on Saturday.
And the statement continued, "Parliamentary committees will begin their legislative and oversight work, starting today, Saturday, the ninth of this month."
He pointed out that the first session of the House of Representatives within the second legislative term will be held next Saturday, corresponding to (7/15/2023).
Parliament had entered a legislative recess that lasted for one month, after it enacted the federal general budget law for three fiscal years (2023, 2024, 2025).
Prior to that, the head of the “Parliamentary National Support” bloc, Representative Mortada Al-Saadi, addressed the Speaker of the Iraqi Parliament, Muhammad Al-Halbousi, regarding the proposal for the “ban on homosexuality” law.
It is noteworthy that the Sanad al-Watani bloc is among the coalition forces that included the coordination framework, and all of them support the legislation of this law, according to statements made by the representatives of those forces.
In an official letter issued by Representative Al-Saadi, addressed to the Speaker of the House of Representatives, titled (Proposal for the Prohibition of Homosexuality), it was stated that, based on the provisions of Article II of the Constitution and the provisions of Article 121 of the internal system of Parliament No. For the purpose of presenting it on the Council’s agenda for the first reading in the second legislative term.
For his part, Aref al-Hamami, a member of the Legal Committee, stated, “The committee hopes to enact a law to criminalize all those who promote and support deviant paths.”
Al-Hamami, a member of the State of Law Coalition that is affiliated with the coordination framework, added that “all political blocs support the enactment of a law that criminalizes homosexuality, deviant acts, drugs and other negative phenomena.”
He pointed out, "It was agreed within the House of Representatives to collect signatures after it reconvened to legislate a law banning homosexuality in Iraq."
Al-Hamami added, “The legislation of such a law will be reinforced by legal provisions that prohibit homosexuality and the deviations associated with it.”
And he continues, "The reason behind taking this step is to distance Iraq from this phenomenon, which is alien to Iraqi society, and is present in many societies in the world."
Al-Hamami concluded that “the committee held preliminary discussions with the majority of deputies,” stressing that “it does not appear that there is any member of Parliament who opposes the draft law or does not vote in favor of it.”
The leader of the Ahl al-Haq movement and one of the most prominent leaders of the coordination framework, Qais al-Khazali, said in a tweet earlier this month, “After all that has been mentioned about the seriousness of the malicious American projects that target the values and traditions of Iraqi society, it has become obligatory for all honorable people in Parliament to legislate a law that criminalizes homosexuality.” with his New American (homosexual) treatise”.
Al-Khazali stressed the need for this law to be “a guarantor to find immunity and adequate protection for the values, beliefs and authentic morals of Iraqi society.”
Activists in the human rights field stress the importance of parliament's preoccupation with laws that serve the people, according to the responsibility it must bear, and that it not focus its efforts on other marginal laws.
Activist Riyad Al-Samawi said, in press statements, that “the political forces with parliamentary weight move the compass of legal legislation according to their vision, not in accordance with the interest of the people, and that service laws that represent an urgent need for citizens are suspended and need to be resolved, while parliament is occupied with marginal laws.”
And he stressed that "the real achievement of parliament is serving the people, serving the citizen, and ensuring human rights, and that any law that contradicts human rights should not be legislated based on the wishes of certain forces."
Earlier, legal expert Ali Al-Tamimi said, “The Iraqi Penal Code punishes deviance or sodomy in Article 393 of it with death.”
Al-Tamimi added, “Law 234 of 2001 punished adultery, sodomy, and brokering with death as well, and articles 215 and 220 punished with imprisonment and a fine for defaming the country’s reputation with such crimes.”
He pointed out that “Article 376 of the same law punishes 7 years imprisonment for void contracts in marriage contracts, as well as Articles 401 and what follows and related to accidental indecent assault, and also Article 3 of the Personal Status Law establishes the terms of the contract and such crimes violate that.”
