UNITAD bargains with Baghdad for evidence condemning ISIS

Activists revealed that the United Nations “Unitad” team specializing in monitoring ISIS crimes in Iraq demanded the abolition of the death penalty in exchange for handing over evidence to the Iraqi government, indicating that the number of documents collected by the team amounted to approximately 9 million documents, while they confirmed The team failed to assign jobs to minorities in its departments.
Former member of the House of Representatives, Saeb Khader, told Al-Sabah: “The UN team worked for years, and according to its data, it collected more than 9 million documents and evidence, which are good for proving international crimes that occurred, such as genocide and crimes against humanity.”
He added, "The team's mission was determined to deliver evidence to the Iraqi government in accordance with the Security Council resolution under which it was formed, and in practice the team must adhere to that," indicating that "at the same time, it must establish a fair trial process for ISIS members through a law, and this is what requires... The Iraqi government and parliament also - before requesting the end of the work of this team - must have a law that prosecutes these elements, describes the crimes, holds their perpetrators accountable, and compensates the victims.
Khader explained, “The process of ending the team’s work requires time and effort from him and the government by completing the mechanisms and legislating a law that complies with the requirements of the international resolution above, holds ISIS members accountable, and does justice to the victims. As for ending the team’s work without Iraq’s technical and legal preparation to assume its duties, I believe it will not achieve the purpose.” For which it was created.
He stressed that “the team failed to involve minorities in its functions and work, as it had to give jobs to the Yazidis and other minorities in the team’s departments to support its work and provide a correct picture of the crimes that occurred against them.”
For his part, the head of the Strategic Center for Human Rights in Iraq, Fadel Al-Gharawi, said, “The team collected 2 trillion digital terabytes of information regarding the crimes of ISIS gangs.”
Al-Gharawi told Al-Sabah: “The team worked to digitize much of this evidence, and there are many interviews with victims, and the official briefings presented by the head of the team to the Security Council shed light on the most important crimes and were considered international documents, and therefore the team’s primary mission was great.” “A lot of people relied on him, especially for the victims.”
He added, “Iraq is in dire need of such international teams, to implement what was framed by the UN resolution, which is the subject of evidence and timelines, since the team was very late in doing so and the state did not benefit from this evidence that it had in its possession in conducting trials for these crimes, as was indicated by the team’s work.” He suspends the process of submitting this evidence to the Iraqi state until after the death penalty is abolished, while the government has an opinion on this matter, especially since Iraq is still exposed to terrorist stations and crimes, and it is difficult to abolish them against criminals who committed crimes of genocide and humanity.”
Al-Gharawi explained, “Iraq had options related to the gradual punishment, and when terrorism ends, the death penalty is considered, reviewed, and penalties are amended, and there is the possibility of stopping them. In the future, there may be a decision to abolish them. As for suspending the delivery of evidence until after the death penalty is abolished, this contradicts the texts and texts of the Security Council resolution that Accordingly, the team was formed, and thus there may be an impact regarding the subject of the trials.”
He stressed that “the team’s withdrawal does not greatly affect the issue of justice because it is linked to the existence of a just national judiciary that applies the laws and has complete independence, especially with regard to the issue of its comprehensive jurisdiction. The government is also heading to approve the International Crimes Law, which will be national and implemented by the judiciary, and will have A major role in conducting the simulation after receiving evidence from the team.”
Al-Gharawi pointed out that “the government may have a review in the event that there is a need for such teams in the future to conduct fair trials on its soil.”
