WASHINGTON (Reuters) - A US appeals court denied President Donald Trump's administration today the transfer of a US citizen accused of being a member of a terrorist group from a military prison in Iraq to an undisclosed state.

The man, who was not named, holds a dual Saudi-American nationality and was arrested in Syria and held in Iraq without legal representation until the American Civil Liberties Union entered his name at the US Federal Court in October.

The US administration has sought to transfer the man even though US courts have not ruled out the legal challenge filed for his release. The District Court of Appeals of the District of Columbia on Monday upheld the ruling by US District Judge Tania Chutcan last month, For this man.

State Department spokeswoman Kerry Kubick said the government had reversed the decision.

Saudi Arabia is believed to be the country the United States seeks to send him to based on media reports and a reference to an unedited version of a court case.

The US Civil Liberties Union filed a lawsuit on behalf of the man, saying the United States had no right to detain a US citizen without charges and had the right to challenge his detention and said his detention violated the US Constitution's commitment to due process.

The Syrian Democratic Forces arrested the man in September before handing him over to the United States.

Washington says it has evidence that the man was a member of the terrorist group "Da'ash" in 2014 and entered Syria in January 2015, according to court papers, which also indicate that the detainee with a degree in electrical engineering is married and has a child.

The American Civil Liberties Union said Trump's administration did not provide evidence that the man had fought in the ranks of the Da'ash organization (banned in Russia), adding that if it had evidence of crimes, the United States should have indicted him before the courts. Exercise his constitutional rights.
