BAGHDAD (Reuters) -
A US military judge has decided to commute the punishment of US special forces officer Edward Gallagher, accused of war crimes in Iraq.
Judge Aaron Rogue refused to drop the murder charge for the special operations officer of Navi Sills against the background of a scandal in which the prosecution attempted to spy on Gallagher's letters, leading to the recent expulsion of the chief prosecutor.
The judge considered that the actions of the plaintiffs damaged the preparation of Gallagher's lawyer to defend their client, violated the constitutional rights of the officer, in addition to damaging the reputation of the US military judiciary.
The judge has vowed to keep the maximum sentence, that is, life imprisonment without early release, if the officer is convicted of murder in one of the most prominent war crimes cases in US history.
As a result of this decision, the officer faces, in the worst case scenario, a life sentence but with the possibility of early release.
Rogge also said Gallagher's lawyers would be allowed to reject two more people during the jury process at the start of the trial, without mentioning the reason.
The chief prosecutor of the Gallagher case, Christopher Chaplack, was dismissed on Monday in a rare step, saying he was not authorized to determine whether tangle-ups were involved in misconduct, but that the move was needed in the current circumstances.
Gallagher, a 39-year-old leader of the 39-year-old Navi Sills, is due to begin trial on June 17. He faces charges of killing unarmed civilians, a girl and an elderly man, and slaying a wounded member of the Da'ash organization with a knife in Iraq in 2017.
However, Gallagher is expected to be among the military defendants or convicted of war crimes cases that President Donald Trump announced in May to pardon them.
