Parliament is witnessing movement towards opening one of the most thorny files in Iraq, which is “state real estate,” which was seized by parties, armed factions, and various political figures in the years following 2003, and who were able, through their influence, to manipulate the identity papers of many real estate properties.
With Parliament intending to read the draft law on returning properties to their owners during next Saturday’s session, the media advisor to the Prime Minister, Diaa Al-Nasseri, warned against the draft included in the Parliament’s agenda, stressing that it will open the door to corruption.
There is no official census of the value of citizens’ property that was stolen and transferred, but it is estimated (according to observers) that the value of state property, which was seized by various political forces after 2003, is more than 20 billion dollars.
Al-Nasseri said, in his blog post on the “X” platform, “We saw in the Parliament’s agenda in the 20th session, paragraph four: (Returning properties to their owners...) and as much as the title seems fair to the rights holders, it may open dozens of doors of corruption.” Billions are draining the state’s financial resources and burdening it economically under a bright title.”
He expected that "this law will open the door to the re-evaluation of thousands of previously sold properties to those who believe that the evaluation of their properties was unfair."
The agenda of the House of Representatives, in its session scheduled to be held next Saturday, included the first reading of the draft law to return real estate to its owners, which is covered by some decisions of the (dissolved) Revolutionary Command Council.
On March 25, the Ministry of Justice announced the monitoring of dozens of counterfeit real estate properties in Baghdad and Mosul, while indicating the formation of an investigative committee to resolve the issue.
The Federal Integrity Commission issued statistics in 2022, which included its monitoring of (31,378) properties belonging to the state, seized or encroached upon, in all Iraqi governorates, with the exception of those belonging to the Kurdistan region, of which Nineveh had the largest share, with (8,585) properties, of which only (35) properties were recovered. Just.
In 2021, the Federal Supreme Court in Iraq canceled a legal text that was exploited by influential parties over those years by seizing and disposing of state real estate. It confirmed that the text was unconstitutional, and none of the previous governments succeeded in resolving this issue, despite many attempts. While some governments were accused of being “not serious” about returning property to their owners and withdrawing state property from the entities controlling it.
