, the legal advisor to the President of the Republic, Munif Al-Shammari, revealed, on Wednesday, the most important paragraphs of the draft penal code, while indicating that the draft will address the sanctity of private life.
Al-Shammari told the official news agency, "The Penal Code was directed by the President of the Republic, Barham Salih, after sending the draft of the project from the Supreme Judicial Council as an initial draft."
He added, "President Saleh formed a committee of specialists in the Legislation Department at the presidency and professors from all Iraqi colleges, in addition to professors specialized in criminal law."
He pointed out that "the Presidency of the Republic has been working on the law for more than two years," noting that "the project was suspended for a short period as a result of the Corona pandemic."
He added, "The draft of the project that came from the Judicial Council was drawn up and an amendment was made to it in some paragraphs," explaining that "the project included new ideas, including alternative penalties, which means replacing the imprisonment penalty with a financial fine or forced labor in the service of society, for the accused whose imprisonment period is Less than a year (simple imprisonment).
And he indicated that "the accused, instead of being imprisoned and the state disbursed on him, is charged for the benefit of the state, works for free, and is placed in a specific place and monitored electronically."
He pointed out that "one of the new principles that were touched upon is (the sanctity of private life), which was not addressed in the previous penal code, which is nearly 50 years old," noting that "the (the sanctity of private life) law relates to family secrets related to photography, publishing and leaking conversations. A special penalty has been set for this, as well as a penalty for anyone who insults the word of God, pointing out that "a special penalty has also been set for anyone who publicly attacks the beliefs of any sect or religious group in Iraq."
And he added, "The draft law also included a penalty for those who practice witchcraft and sorcery, which was not addressed in the past," pointing to a penalty for impersonating websites with fake names or impersonating a specific person's name, as well as penalties for recording calls or taking and leaking photos.
He stressed that "a penalty has been set within the new principles for anyone who leaks and divulges the secret of exams, in addition to setting a penalty regarding medicines and their improper trading, as well as a penalty for doctors who prescribe fake treatments to citizens."
He added, "The project tried to address information crimes until the law is passed in Parliament."
The President of the Republic, Barham Salih, confirmed, on Tuesday, that the Penal Code is the first in 50 years.
And the media office of the President of the Republic stated in a statement that “Mawazine News” received a copy of it, that “in an expanded meeting, the President of the Republic, Barham Salih, presented, at the Peace Palace in Baghdad, the new draft penal law to the House of Representatives, which was submitted by the Supreme Judicial Council to the Presidency of the Republic in the context of Cooperation between the Presidency of the Republic and the Supreme Judicial Council in the field of legislating laws required by the developments of the times, to replace the Penal Code of 1969, and based on legal drafting and harmonization with the Iraqi legislation in force and not violating the Constitution, and not inconsistent with international covenants, aiming to achieve security, solidarity and stability.
He added, "The meeting included the First Deputy Speaker of the House of Representatives, Hassan Al-Kaabi, the Parliamentary Legal Committee, the President of the Bar, the President of the Iraqi Jurists Union, a number of experts and legal scholars, and a group of academics who are professors of law in Iraqi universities."
According to the statement, Saleh said, "The new draft law is the most comprehensive amendment in fifty years to the Iraqi Penal Code of 1969 and its amendments made to it by the dissolved Revolutionary Command Council and orders issued by the Coalition Provisional Authority," noting that "the draft was adopted by the Supreme Judicial Council and was approved by the Supreme Judicial Council. Consulting the State Council in it, while the Council of Advisors in the Presidency of the Republic worked on it by taking advantage of the Iraqi competencies and the various jurisprudential circles to reach a formula that fits with the new situation in Iraq.
He added, "There have been major transformations in Iraq during the past decades, but its legal system and the penal code in particular remained in a framework that did not keep pace with the developments that occurred in the political system and in Iraqi society," noting that "one of the most prominent features of the new law is the establishment of deterrent punitive texts to combat crimes. Financial and administrative corruption, preventing impunity and obligating embezzlers to return funds, criminalizing acts and tightening penalties for crimes committed against the national economy, and the law attaches great importance to protecting the family and criminalizing acts committed against it.
Salih stressed that "the new draft law has taken into account all international agreements and treaties, especially those ratified by Iraq as part of national law and through consulting the United Nations and the Red Cross, and it will have positive consequences that place Iraq in the ranks of countries committed to international law and international standards related to crime." punishment, personal freedoms, and abuses that occur in society.
