The Association for Defending Freedom of the Press in Iraq has seen a copy of a complaint document submitted by the Speaker of Parliament, “Mohammed Al-Halbousi” to the judiciary, through his lawyer, against Al-Tagheer satellite channel, its director and presenter, “Najm Al-Rubaie” against the background of the latter asking a question in one of the episodes of his political program, and the content of his political program. The program's guest was made by former parliament member Mishaan al-Jubouri.
Al-Halbousi submitted the complaint to the Karkh First Investigation Court against the program presenter, colleague Al-Rubaie, claiming that he deliberately raised a question that prompted his guest to make statements that Al-Halbousi (in the complaint submitted to the judiciary) considered affecting security and civil peace in the country.
The document indicated that Al-Halbousi based the lawsuit on legal article (111) of the Penal Code of 1969, and the provisions of the Anti-Terrorism Law, in dealing with a media outlet and program presenter, who based their journalistic work on the constitution that guarantees freedom of press and media work in the country.
The Society for Defending Freedom of the Press in Iraq confirms that the presenter of the program and the media outlet are not responsible for the statements made by the guest on the air about politicians, and the current conditions, and the presenter has the right to raise any question under Article 38 of the Constitution, which guarantees freedom of journalistic work in all its forms.
The association expresses its concern about the recurrence of the scenario of initiating lawsuits that politicians submit against media workers, with the aim of undermining the freedom of journalistic work and expression of opinion, especially since the complaint was submitted following the questions raised in the program, which is a dangerous precedent, as the authority holders aim To blackmail and terrorize journalists with laws inherited from the dictatorship era, specifically from the sixties and seventies of the last century, which the association considers a new suppression of freedom of press work in Iraq.
The recent events and meetings between the owners of the highest authorities in the country indicate the adoption of a new plan in the name of the Iraqi Penal Code, to suppress freedom of expression, opinion and the press, and to prosecute journalists with those laws that contradict the constitution, and to abolish everything guaranteed by the constitution.
The Assembly calls on the Speaker of Parliament to withdraw the complaint, comply with the Constitution and its principles, which stipulate freedom of media work, expression of opinion, and saving what remains of it.
It is noteworthy that this repressive approach was adopted by the heads of the executive, judicial and now legislative authorities, which confirms this dangerous methodology that the press family will not tolerate.
The association calls on legal experts to point out all these harassment, in preparation for the registration of complaints against the heads of authorities in Iraq with UN organizations and international courts.
