    Baghdad/The Obelisk: Legal expert Ali Al-Tamimi mentioned, on Tuesday, November 8, 2022, a number of observations regarding the draft (compulsory military service) draft law, in his comment on the Obelisk report on the controversy caused by the law.
    Al-Tamimi told Al-Masala that the application of the law in Article 3 of it in the region and the governorates will be difficult, and costly because it requires the establishment of recruitment departments, forcing attendance and penalties for those who do not.
    And he continued: Article 5 of the law and the call to service in case of war or emergency is by a decision of the Council of Ministers, considering that it must be by a decision of the Commander-in-Chief of the Armed Forces, i.e. the Prime Minister, and the approval of the Council of Representatives in accordance with Articles 78 and 61 / ninth of the Iraqi constitution..
    Al-Tamimi stated that the law did not provide for the cancellation of the decisions of the Revolutionary Command Council 166 of 1994 and 66 of 1992.. It did not provide for the abolition of the mandatory conscription law 65 of 1969 in force, revealing that Article 63 excluded from service those who practice religious service, but he did not specify who these are .
    The law did not clarify the duration of training in the centers and the duration of presence in the training centers, and whether the training takes place in the same governorate or not.
    Al-Tamimi said that the law did not clarify or treat the case of dual Iraqis.
    Al-Tamimi calls for the law to be postponed later due to the instability of the situation in the country, calling for it to be presented to public opinion, the media and specialists.
    What's the story?
    The controversy has increased in Iraq regarding the draft law to restore the compulsory military service, which was submitted to the House of Representatives, between one who rejects it and another who supports it.
    Supporters see it as an assimilation of unemployed youth, while those who reject it find disguised unemployment without production and a new gateway to corruption.
    Compulsory military service was abolished after the fall of the previous regime, in 2003.
    And Parliament Speaker Muhammad al-Halbousi considered in a tweet on Twitter that proceeding with the legislation of the Science Service Law ensures the preparation of a generation of young people more capable of facing life's difficulties.
    The leader of the Al-Fateh Alliance, Ali Hussein Al-Fatlawi, believes that the draft compulsory service law has two negative and positive aspects, and the first may be a new gateway to corruption.
    And retired judge Rahim Al-Akaili called for stopping the legislation of the compulsory service law, returning it to increasing financial burdens on the state, and opening new wide doors to corruption.
    The economic expert, Salam Sumaisem, considered that compulsory conscription is a flight forward to get rid of unemployment problems and the government's obligations towards the problems of poverty and unemployment.
    Dr. Hussein Abbas suggested passing the compulsory education law instead of the compulsory conscription law.
    On August 31, 2021, the former Iraqi government, headed by Mustafa Al-Kazemi, approved a draft law for compulsory conscription in the military and referred it to Parliament for legislation.
    The draft service law, which contains 66 articles, obligates males between the ages of 19 and 35 to perform military service with a period ranging from one and a half to two years for those who do not have a degree or educational attainment, one year for those with a preparatory certificate, six months for those with a high school diploma, and two months for those with a high school diploma. On higher degrees. As for the option to pay the cash allowance, it is for those who cannot serve.
    The observer of the Iraqi issue, Habib Al-Asadi, expects that the law of compulsory service will be applied to the children of the poor, especially the center and the south, while the writer and activist Hassan Al-Kaabi believes that there are those who do not want a trained and strong army, and there are those who do not accept the creation of a strong, conscious generation far from drugs, considering that conscription Compulsory is the only reform for the youth of Iraq.
