And a member of the Parliamentary Security and Defense Committee, Representative Hussein Al-Amiri, stated in an interview with “Al-Sabah” that “the reason for withdrawing the compulsory recruitment law by the Presidency of the House of Representatives and returning it to the government - on the grounds that it was carried over from the previous government - is the lack of agreement between the political forces on the content of the law.” The Prime Minister has been approached that the law be re-amended to suit the opinions of the political forces and their masses, in a way that ensures that it is read first and that it is voted on by the House of Representatives in the fifth session.
He added, "The repercussions of approving the compulsory conscription law are to strengthen the national social bond and also to alleviate unemployment among young people and enable them to continue their work, in addition to the fact that society needs to enact such a law in order to help evaluate young men as men with potential, with whom young people feel responsible towards their country." ".
He pointed out that "one of the main points of the government's review of the law is to reconsider the length of service and reduce some of the penalties stipulated in the law," explaining that "the political forces can agree on the points and paragraphs of the law and return it again to the House of Representatives and vote on it."
For his part, the security expert, Sarmad Al-Bayati, said in an interview with "Al-Sabah" that "the law ebbs and flows, between the government and the parliament, and it was discussed a lot, as it has opponents and supporters."
He explained, "Supporters of the law believe that it is necessary to enroll Iraqi youth in courses in order to serve the country and eliminate sectarianism, and there is strategic planning for young people to enter compulsory service after graduating from colleges in a way that provides them with a monthly salary until their situation is arranged after completing the period of military service." .
He pointed out that "opponents of the law are talking about suspicions of possible corruption in the law and issues related to freedoms, so the law will remain between supporters and opponents until the political blocs agree on its broad lines to sign and approve it." While the legal expert Ali Al-Tamimi expressed, in his interview with "Al-Sabah", his observations on the draft law, indicating that the name that should be called "flag service" and not "military service" or compulsory, as stipulated in Law 65 of 1969 as well as Article 9 Second of the Iraqi constitution.
And he indicated that "the ages of those covered by this service range from 18 years to 45 years," suggesting that the upper age limit be "35 years" in line with the current living conditions.
Al-Tamimi identified several articles and paragraphs in the aforementioned law, expressing his hope that it would be amended and changed before its approval, including Article 5, which stipulates that the call to service in the event of war or emergency is by a decision of the “Council of Ministers,” while it is more correct that it be by a decision of the Commander-in-Chief of the Armed Forces. - That is, the Prime Minister - and the approval of the House of Representatives in accordance with Articles 78 and 61 / IX of the Iraqi constitution. He also stressed the difficulty of applying Article 6 of the law, which is related to examining marketers for service by committees in the governorates and the region, and the impossibility of controlling those committees without the presence of a higher appeal committee.
He pointed out that the positive step in the law is Article 10, which gave the breadwinner, according to a judicial support decision, the salary of the mutawa, while the salaries of marketers for the service were not specified, stressing that the penalties were not specified in their entirety, and that from Article 34 and beyond and related to penalties need to be comprehensively reviewed, In addition, Article 48 of the law did not specify for us the amount of cash allowance to be paid for exemption from service.
The legal expert continued, that the law did not provide for the cancellation of the dissolved Revolutionary Command Council Resolutions 166 of 1994 and 66 of 1992, nor did it provide for the cancellation of the compulsory recruitment law 65 of 1969 in force, while Article 63 excluded from service those who practice (religious service) and the text did not clarify from What is meant by this definition? Al-Tamimi also indicated in his speech, to a number of vague matters in the text of the law, including: training centers, the duration of presence in them, whether training takes place for the marketer in his governorate, and the status of dual nationals among Iraqis, calling for presenting the law to public opinion, the media and specialists before proceeding to read it and vote on him.
