expert in legal affairs, Ghaith Al-Shammari, confirmed that government contracts with investment companies are weak from a legal standpoint.
Al-Shammari said, in a televised interview followed by Mawazine News, that “Iraqi law is considered the prevailing law in the field of contracting with foreign companies or even Arab companies, as it stipulates that any problem arising between the contracting government and the company shall be resolved in the Iraqi courts.”
He added, "Some foreign companies worked to distort the contract, as they worked to contract from within the Jordanian side to avoid the Iraqi courts in the event of any problem arising between the implementing company and the Iraqi government contracting with it."
He pointed out that "many government contracts with investment companies are poor and lack Iraqi legal texts and auditing, pointing out that there are many companies that have put in place a legal text during the agreement that stipulates that the outbreak of a problem between the company and the Iraqi contracting side should be resolved in the courts in London or Amman."
