(Baghdad: Al Furat News) The Federal Supreme Court issued a constitutional provision on the recognition of civil education in Iraq, stressing that the subject of equivalence of certificates between the public and private sectors is vested in the Ministry of Higher Education and Scientific Research.
"The Federal Supreme Court held its session under the chairmanship of Judge Medhat al-Mahmoud and the presence of all members of the judges, and considered the appeal of Article (42 / I) of the Law of Higher Education National No. 25, Of 2016 ".
"The prosecutor went on to say that the contested material is equal to the certificates granted by universities, colleges and private institutes and their counterparts to universities, colleges and official institutes."
"The plaintiff considers that the aforementioned provision of equality violates the provisions of Articles 14 and 16 of the Constitution, which stipulates equality and equality of opportunity. In his opinion, the admission rates and conditions in universities and colleges are different from those in universities, colleges, Certificates can not be equal in the formal and family sectors. "
He pointed out that "the Federal Supreme Court, found that the subject of equivalence of certificates belongs to the Ministry of Higher Education and Scientific Research, and if there is a university or college or institute does not meet the scientific conditions can not leave or leave the leave and not to recognize the certificate it gives.
The spokesman added that "the court stated that the question of the disparity in admission rates between universities and colleges and civil institutions in the official may be found between universities and colleges and institutes, according to time and place."
He pointed out that "the Federal Supreme Court confirmed that the bond mentioned by the plaintiff, articles 14 and 16 of the Constitution, the meaning of equality and equality of opportunity is contrary to what the plaintiff presented in his lawsuit; because it calls for opportunities for those who did not seek the average acceptance in Universities, colleges and institutes, and that the body responsible for monitoring the scientific level is the Ministry of Higher Education and Scientific Research, and stakeholders and organizations can cooperate for that.
He went on to say that "the Federal Supreme Court and based on the above decided to respond to the lawsuit because it is not based on the basis of the Constitution."
