Specialists consider the “Retirement and Social Security for Workers” law one of the most important laws that contribute to the living and economic stability of citizens, considering that it is no less important than the “civil service” and “salary scale” laws, and they also stressed that if the law was applied accurately, it would constitute a real pillar To relieve the burden of the state by strengthening the private sector, at a time when the Ministry of Labor and Social Affairs revealed that many company owners evaded paying the insurance that should be paid for their insured workers.
A member of the Parliamentary Legal Committee, Raed Al-Maliki, said in an interview with “Al-Sabah”: “The guarantee law is important, especially if we count the large number of workers in the private sector who are included in it.” On a rewarding retirement, this will relieve the burden of the state and the government in terms of competition for the public office.
He added, "It is necessary to think about ways and means to attract the private sector, including companies, factories, and the unorganized labor sector, which Parliament is trying to include in retirement provisions. burden on her.”
He explained, "This will happen in multiple ways. To start with, emphasis must be placed on applying the law, and privileges must be provided to companies and factory owners by granting them exemptions for certain matters or privileges in the event that the workers working for them are guaranteed, and the state must also enter its treasury and contribute to a fund." Workers’ retirement and do not impose a high percentage of subscriptions on employers from companies and the private sector, because this may lead them to evade the guarantee of the workers they have.”
Al-Maliki called on the competent authorities to "provide a package of concessions through consultation with the owners of companies in order to find out the reasons for their evasion from guaranteeing workers," explaining that "the majority of workers are not insured, and the reason is that companies evade employers from guaranteeing workers in the retirement fund."
On his part, the spokesman for the Ministry of Labor and Social Affairs, Najm Al-Aqabi, said in an interview with “Al-Sabah” that “the retirement and social security law imposes the deposit of 5% of the worker’s salary and 12% of the employer’s salary in the retirement fund, so employers and companies are evading of the insurance payments.
He explained that "the law has very great privileges, and we have given the private sector priority over the government sector, so there will be equal opportunities in terms of rights and duties after the law is approved."
He added, "The Minister of Labor and Social Affairs obtained the approval of the Prime Minister to give an opportunity for companies or foreign workers in Iraq for a period of 45 days to correct their legal status, and this includes all those entering the country in the form of religious tourism or a visit, with the exception of those who entered through the Kurdistan region, as they are not included." .
And Al-Aqabi indicated that "the ministry has opened an electronic window for workers to correct the legal path for those who entered legally, and to include workers in these companies with social security," stressing that "most company owners evade their workers' guarantee procedures in accordance with the law."
