Baghdad/Al-Masala Al-Hadath: The head of the Parliamentary Rights Bloc, Saud Al-Saadi, responded on Tuesday to the Kuwaiti Foreign Ministry’s request for the Iraqi government to issue an explanation of its position on crossing the lines dividing the two countries and infringing on Kuwait’s sovereignty.
Al-Saadi said in a statement, “At a time when we were waiting for the Iraqi Prime Minister and Foreign Minister to implement the decision of the Federal Supreme Court No. 105 and its unified No. 194/Federal/2023 issued on 9/4/2023, which included the unconstitutionality of Law No. 43 of 2013 (Law Ratification of the agreement between the government of the Republic of Iraq and the government of the State of Kuwait regarding the regulation of maritime navigation in Khor Abdullah) in addition to the Ministry of Foreign Affairs issuing a statement of protest or response to the decision of the foreign ministers of the Gulf Cooperation Council countries taken on 9/17/2023 or a response to the State of Kuwait’s protest against the decision The Federal Supreme Court above.”
He added: “We were surprised that the Iraqi Ministry of Foreign Affairs informed us of the phone call between the Kuwaiti Assistant Foreign Minister and the Iraqi Ambassador to Kuwait, which included baseless accusations.”
He pointed out that, “Based on our representative duty on behalf of the Iraqi people with all its components in accordance with Article (49/First) of the Constitution, we emphasize moving forward by completing the legal procedures and issuing an official warning against the Ministry of Foreign Affairs, which refrains from implementing the decision of the Federal Supreme Court mentioned above despite It has absolute authority and is binding on all authorities inside and outside Iraq in accordance with Article 94 of the Constitution, in addition to obligating the government, through the Ministry of Foreign Affairs and the Permanent Representative of Iraq to the United Nations, to deposit and register the decision of the Federal Supreme Court mentioned above with the General Secretariat of the United Nations.”
Al-Saadi stressed, “Khor Abdullah al-Iraqi (Al-Tamimi) is part of Iraqi sovereignty that must be protected by the President and members of the House of Representatives, the President and members of the Council of Ministers, and all public authorities in Iraq in accordance with the provisions of Articles 1, 50, 79, and 109 of the Constitution of the Republic of Iraq for the year 2005.”
The head of the Human Rights Bloc called on “Kuwait to respect bilateral relations between the two countries, and not to resort to illegal methods in leveling arbitrary accusations against those who defend Iraqi sovereignty.”
He concluded by saying: “We pledge to the Iraqi people that we will complete what we have begun of constitutional appeals before the Federal Supreme Court to recover the established historical sovereign rights of Iraq from the State of Kuwait, whether related to encroachment on Iraqi oil wealth in fields shared with Kuwait or other decisions or protocols signed between The two states violate Iraq’s full and undiminished national sovereignty over Iraqi lands and waters.”
