In the coming days, the House of Representatives is preparing to vote on amending the law on the foundations of equivalency of certificates 2020 after completing the first and second readings in order to end the chaos that occurred in the past few years, which allowed employees to study outside the country without controls.
A member of the Legal Committee, Muhammad Jassim Al-Khafaji, said in an interview with “Al-Sabah”: The 2020 law on the basis of equivalency of certificates allowed the ministries to calculate all previous certificates that are before the date of the law’s approval and their equivalence that were not previously calculated, in addition to the equivalence of initial certificates for all employees who obtained them. Without study leave over the past four years, which resulted in hundreds of certificates being counted.
Al-Khafaji pointed out the deletion of articles from the law, including that the employee must obtain the necessary approvals from his department before starting his studies and travelling, in addition to obtaining approval from the Ministry of Higher Education exclusively, without just the approval of his department.
He added that many of the articles of the law are unconstitutional and the Federal Court ruled them unconstitutional, noting that Article 12 of the law stipulates that those assigned to public service and employees, including directors, agents, and general managers, can study during employment or assignment now.
He explained that this article was completely abolished because it was in itself a “disaster” and now we are facing an amendment that prevents the exploitation of the job and public service for the purposes of study and personal gain, indicating that one of the controls established by the amendment to the law is changing the length of residence for master’s and doctoral studies after it was four months for humanitarian studies. For science, six months.
Al-Khafaji added that if the legislative term is extended, it will be voted on, and if it is not extended, it will be voted on after the recess, since the law is ready and all the comments that were given are simple and the Parliamentary Education Committee is professional in amending it, explaining that the amendment stops the chaos that occurred by studying without leave and the employee goes outside the country, gets accepted and continues. He completed his postgraduate studies and demanded the equivalency of his certificate, which caused an abnormal increase in the number of students and holders of advanced degrees in government departments.
