    The Council agreed, according to the statement, that “the Ministry of Finance will take the necessary measures to allocate and finance the costs of supplying the gas oil product to the State of Palestine, which is supplied in accordance with Council of Ministers Resolution (23640), provided that the Ministry of Oil determines the amount later, in order to improve the status of airports and develop and rehabilitate the infrastructure.” Infrastructure and improving services therein, what was stated in the letter of the Ministry of Transport dated February 27, 2024, regarding maintenance and rehabilitation work, was approved, as an exception to the contracting methods stipulated in the Instructions for Implementing Government Contracts (2 of 2014).”

    1. The financial allocations for the years 2024 and 2025 shall be approved for the investment and credit accounts for the Iraqi-Chinese agreement projects.

    2 The launch of financing for the aforementioned projects will be from the Ministry of Finance, and with the approval of the Prime Minister, based on the recommendation of the Diwaniyah Order Committee (23995 of 2023), and at the request of the implementing authority, and the committee may return the surplus financed amounts to the investment account.”


    In the field of energy, the Council took a number of important decisions, as follows:
    First: Approving the recommendation of the Ministerial Council for Energy (24004 of 2024) regarding excluding the entry of materials for the cofactor cracking (FCC) project in the Basra Refinery, according to the following:
    Excluding the entry of chemicals from... Issuing an import permit and clearing it from customs upon its arrival at the ports, and communications equipment within the Southern Refineries Company site for the FCC project in the Basra Refinery are among the necessary approvals, provided that the import permit and the required documents are completed later; This is to ensure the speedy progress of work on the aforementioned project and reduce losses resulting from delays due to these procedures.

    Second: Approval of the Ministerial Council for Energy’s recommendation (24009 i) for the year 2024 as follows:
    Approval of the final consensual settlement between the Ministry of Oil/Basra Oil Company and Petrofac, to reduce an amount for the project to establish the second central processing plant (CPF2) in the Majnoon oil field, held on 6 November 2023, and falling to (27,500,000) dollars, instead of (30) million dollars.

    Third: Approval of the Ministerial Council for Energy’s recommendation (24005 of 2024) regarding a memorandum of understanding to benefit from burned gas to produce electrical energy in Iraq, through the national electricity distribution network, according to the following:
    Approval to authorize the Undersecretary of the Ministry of Oil for Gas Affairs to sign a memorandum of understanding. To benefit from burned gas to produce electrical energy in Iraq with the American company (GE), while directing the Ministry of Electricity to sign a similar memorandum to establish stations related to burned gas.

    Fourth: Approval of the recommendation of the Ministerial Council for the Economy (No. 24049 of 2024) regarding amending the price of Qayyarah Refinery products (heavy gas oil, mixtures, and asphalt), according to the following:

    1. The price of the heavy gas oil product is (300 dinars/liter) for the official price, and (350 dinars/liter) for the commercial price.
    2. The price of the mixture product will be (250 dinars/liter) for the official price, and (300 dinars/liter) for the commercial price.
    3. The price of the S125 asphalt product is (250,000 dinars/ton) for the official price and (300,000 dinars/ton) for the commercial price.
    4. The price of asphalt product (40/50) will be (300,000 dinars/ton) for the official price, and (350,000 dinars/ton) for the commercial price.
    5. It includes all government agencies, and laboratories licensed by the Industrial Development Corporation that have the approval of the Ministry of Oil in paragraphs (1, 2, 3, and 4) mentioned above, provided that prices are reviewed after (6) working months, starting from the date of issuance of this decision.

    Fifth: Approval of the recommendations of the minutes of the meeting related to the Al-Faw Refinery Investment Project, held on February 17, 2024, according to the following:

    1. Completing the investment procedures for the Al-Faw Refinery Investment Project, and Iraq’s share in the project will be (20%) of the project value, according to what was agreed upon between the Ministry of Oil and the investing company, and is included in the contract that will be signed between the two parties.
    2. The Ministry of Finance owns the share mentioned in paragraph (1) mentioned above.
    3. The Ministry of Finance authorizes the Ministry of Oil/General Company for Southern Refineries to sign as the first party on its behalf.
    4. An agreement will be made between the Ministry of Finance and the General Company for Southern Refineries to sign an appropriate wage contract between them, in exchange for managing the Ministry of Finance’s share in the project.
    5. The Ministry of Finance took the necessary procedures to register the entire port campus in the name of the Ministry of Finance, and allocate the necessary land for the refinery project and future expansions of the project, according to the maps approved by the international consultant for the Al-Faw port project.
    6. The project is subject to the provisions of the Refinery Investment Law (64 of 2007), as amended, and the instructions issued to implement the law.
    7. The price of crude oil prepared to meet the project’s need shall be in accordance with what was stated in Article (5) of the law mentioned in Paragraph (6) above.
    In continuation of the government’s approach to launching work on service and lagging projects, the Council voted on the following:
    First:
    1. Increasing the cost for the component (completion of the remaining works for Al-Imam Al-Jawadin Hospital (50 beds in Taji), to become (29,454,806,470 dinars) instead of (28,830). 603,280 dinars)
    2. Increasing the total cost of the project (construction of Al-Imam Al-Jawadin Hospital (50 beds in Taji / turnkey / Baghdad), to become (42,427,000,000 dinars) after rounding instead of (41,803,000,000 dinars), with an increase of (1.5%). ) After rounding off the amended total cost and an increase of (67.312%) over the approved total cost of (25,358,000,000 dinars).
    3. Increasing the total cost of the component (completion of the remaining work for the (40-bed hospital in Dujail)), to become (18,378,115,250 dinars).
    (15,260,184,025 dinars ) An increase of (11,702%) on the total adjusted cost, and an increase of (39.35%) on the total approved cost of (21,357,000,000 dinars).
    5. The Ministry of Health bears the accuracy and validity of the data and information submitted to the Ministry of Planning. The Ministry of Health and the entities preparing and reviewing the tables of quantities also bear responsibility for the prices and specifications stated in the tables of quantities.

    Second:
    1. Increasing the reserve percentage for the component (rehabilitation of streets in the second Al-Nasr neighborhood), to become (24.796%) instead of (10%).
    2. Increase the total cost of the project, to become (30,824,166,660 dinars), instead of (29,656,534,160 dinars) by an increase of (3.93%).

    Third:
    1. Increasing the reserve percentage for the component (establishing Al-Hawraa Maternity and Children’s Hospital in Shatrah), to become (96.95%) instead of (87.38%).
    2. Increasing the total cost of the main project (building and equipping hospitals and medical centers in Nasiriyah - Shatra - Souq Al-Shuyoukh), to become (45,832,058,275 dinars), instead of (43,802,858,275 dinars), and an increase rate of (4.6%) on the adjusted total cost and the percentage An increase of (61.8%) over the approved cost.

    Fourth: Increasing the amount of reserve for the project (implementation of Rawa sewers) by an amount of (57,432,152 dinars) by (12.87%) to become (26.87%) instead of (14%) and within the total cost of the project.

    Fifth:
    1. Increasing the total cost of the (General Population and Housing Census) component to become (400 billion dinars) instead of (120 billion dinars).
    2. Increasing the total cost of the (statistical surveys) project to become (410,060,806,000 dinars) instead of (130,060,806,000 dinars), with a percentage increase over the adjusted total cost of the project (215,284%) after rounding, and an increase percentage (3,975,825%) after rounding over the approved cost. For the project, the increase is beyond the authority of the Minister of Planning and the Ministerial Council for the Economy.
    3. The Statistics and Geographic Information Systems Authority is responsible for the accuracy and validity of the data and information submitted to the Ministry of Planning. The preparation and audit committees composed of the aforementioned authority also bear responsibility for the prices and specifications confirmed in the study submitted to the Ministry of Planning.

    Sixth:
    1. Increasing the reserve amount for the project (constructing water complexes, constructing conveyor lines, and equipping submersibles and sterilization devices in Shatrah), to become (47.9%) instead of (10%).
    2. Increase the total cost of the project to (2,234,537,150 dinars), instead of (1,900,000,000 dinars).
    3. Confirming that Dhi Qar Governorate is careful in preparing statements within the instructions for implementing government contracts for the year 2014. Otherwise, the aforementioned governorate will bear all legal consequences.

    Seventh: Approval of what was stated in the letter of the Ministry of Planning, dated February 22, 2024, regarding the subject of the entrances to the capital, Baghdad, as follows:
    1- Increasing the reserve ratios for the components of the entrances to the capital (Babylon, Mosul, Kirkuk) within the project to rehabilitate and develop the entrances to the capital within the boundaries of the Baghdad Municipality. , included in the investment budget tables of the Municipality of Baghdad for the year 2023, and as shown below:
    A. Increasing the reserve percentage for the (Baghdad-Babylon entrance) component to become (93.688%) instead of (19%), and the total cost of the component to become (46,986.955. 248 dinars) instead of (26,349,126,580 dinars.
    B. Increasing the reserve percentage for the (Baghdad-Kirkuk entrance) component to (282.45%) instead of (10%), and increasing the total cost of the project to become (71,412,697,834 dinars) instead of (19,706. 738,545 dinars).
    C. Increasing the reserve percentage for the (Baghdad-Mosul entrance) component to become (240.71%) instead of (10%), and increasing the total cost of the component to become (48,219,420,570 dinars) instead of (14,635,251,650 dinars).
    2- Increasing the total cost of the project to become (219,507,718,631 dinars), with an increase of (193.06%) over the approved cost of the project.
    3- Establishing a violation against the Baghdad Municipality as a result of the referral of the three components above, at a higher than the total estimated cost within (10%), without approaching the Ministry of Planning to obtain approval to modify the project cost.
    4- The Baghdad Municipality bears the validity and accuracy of the information received, the responsibility for prices and specifications, the correctness of procedures, and the soundness of implementation.
    In the context of the government’s interest in the private industrial sector, and in implementation of what was stated in the Prime Minister’s speech during the national industry support workshop, the Council voted on the following:

    1. The Ministry of Justice/Land Registration Department shall be responsible for isolating the agricultural lands on which existing industrial projects are built and which have obtained a license. Establishment by the General Directorate of Industrial Development, or the Investment Authority, with separate real estate bonds, regardless of their areas.
    2. Obligating the Ministries of Finance, Construction and Housing, and land-owning entities to collect rental fees for all industrial projects established before and after the entry into force of the Industrial Investment Law for the Private and Mixed Sectors No. 20 of 1998, in accordance with the Economic Affairs Committee’s Resolution No. 244 issued on June 9, 2001, and confirmed. Pursuant to Ministerial Council for the Economy Resolution No. 518 of August 15, 2022.
    3. Obliging the Ministry of Finance, the Ministry of Justice, and the Ministry of Agriculture to implement the paragraphs of Council of Ministers Resolution No. 227 of 2020, and the Council of Advisors in the Council of Ministers is responsible for following up on this, and submitting its reports to the Prime Minister on the non-implementing parties. For the decision.
    4. Obliging the Ministry of Oil to cancel the decision to stop supplying industrial projects with fuel, impose a month of maintenance on these projects, and commit to not cutting off their fuel quota.
    5. The General Authority of Customs is responsible for zeroing customs duties for raw materials used in local industries, which are determined according to a detailed list of the types of materials, prepared by the General Directorate of Industrial Development according to the different industrial sectors.
    6. The General Directorate of Industrial Development, in cooperation with the National Data Center in the General Secretariat of the Council of Ministers, is responsible for establishing a unified electronic window for completing the procedures for establishing industrial projects. With the aim of simplifying procedures and shortening the period for granting the establishment completion permit, to a maximum period of two months from the above date, provided that the establishment completion permit is granted to applications received through the window that meet all requirements, within a maximum period of 15 days.
    7. Obliging the Ministry of Finance to issue one liability release annually to taxpayers (individuals or companies that own industrial projects) and for each industrial project separately, addressed to all state departments, and obliging ministries and entities not affiliated with a ministry and all governorates to approve it during the fiscal year that covers its effectiveness, and not to demand A clearance letter addressed to a specific department.
    8. Obliging the Central Agency for Standardization and Quality Control and the Directorate for Combating Organized Crime to follow up on and confiscate all unlicensed laboratories circulating in the local market, and to take the necessary legal measures against the shop owners who trade them and the owners of the laboratories that produce them in accordance with the provisions of the law.
    9. Obligating the Ministry of Electricity to do the following:
    A. Collecting the fees for supplying electricity to industrial projects approved by the General Directorate of Industrial Development and the Investment Authority, according to the industrial tariff, not commercial, and dealing with all current cases of violation.
    B. Take the necessary measures to isolate the feeders of industrial areas from residential areas, within a maximum period of one year, and provide them with electrical power for no less than 8 hours per day.
    10. Obligating all ministries, entities not affiliated with a ministry, and all governorates to implement Article 30 Second of Federal Budget Law No. 13 of 2023, and to cover all their own needs and project implementation requirements through tenders from local products, and the regulatory authorities must follow up on this.

    Directives
    - Directing the Ministries of Interior and Defense, the National Security Service, and the Baghdad Operations Command to stop implementing all previously issued circulars and controls restricting the transfer of iron waste (scrap) and allowing the transfer of these materials without any restrictions between governorates and within a single governorate and region.

    The Council voted to assign each of the following: Majid Ghanem Al-Muhammadawi, Thaer Hathit Ibrahim Al-Ghanimi, Hamad Mahmoud Muhammad Al-Dukhi, Wa’alan Abdullah Abdul-Rahman Rashid, and Sana Saeed Hadi Karumi, were awarded as members of the Board of Trustees of the Iraqi Media Network, and the House of Representatives recommended their appointment as Asala, and the candidate Abdul Hamid Abdul Kadhim Jabbar Al-Taie was excluded from the assignment. Because he exceeded the legal age for service.

    The following was also voted on:
    1. Approval of the draft law on the Republic of Iraq’s accession to the Kigali Protocol of 2016, the Fifth Amendment to the Montreal Protocol regarding Substances that Deplete the Ozone Layer of 1987 annexed to the Vienna Convention for the Protection of the Ozone Layer of 1985, which was prepared by the Council of State, and referred to it to The House of Representatives, based on the provisions of the Constitution.
    2. The Republic of Iraq’s reservation is confirmed that joining the aforementioned Protocol does not mean, in any way, recognition of Israel, or entering into any relationship with it, based on the provisions of the Treaty Contracting Law (35 of 2015).

    The draft law on wages for services in centrally funded state departments was also approved, which was reviewed by the Council of State and referred to the House of Representatives, based on the provisions of the Constitution, taking into account the observations of the Legal Department in the General Secretariat of the Council of Ministers, and the observations presented by members of the Council of Ministers during the session. .
