Alsumaria News - Special
Independent MP Raed Al-Maliki explained today, Friday, what the amendment to the Personal Status Law will include, while indicating that malicious parties tried to mislead the paragraph of the amendment to the law.

Al-Maliki told Sumarya News, "The proposed law to amend the Personal Status Law did not include a text specifying the marriage of minors aged 9 years and above," denying "the accuracy of that information."

He added, "The law did not aim to marry minors and did not include a text specifying the age of marriage," noting that "this information is misleading by malicious parties that the proposed law stipulates that a girl be married at the age of 9 years."

He explained that "amending the law addresses many problems in the current personal status law," asking, "Is the certification of the contract by an authorized person from the judiciary unofficial?"

He stated that "the law remains in effect and is enforceable with all its provisions," noting that "the amendment includes establishing a code in the law, but it was misunderstood after the representatives were misled and deluded with inaccurate words."

He stressed that "the proposed amendment is structural and does not include women's rights and obligations, but rather includes one thing, which is that the Iraqi citizen has the freedom to choose the provisions of the current law, which is the Personal Status Law, or to choose the provisions of a sect of his choice, and they are recorded in a code in the form of a law and returned to be presented to the House of Representatives," noting that "the amendment of the law will be placed on the agenda of the House of Representatives."

MP Alia Nassif issued a clarification regarding the two papers that were distributed in the House of Representatives and included ideas for amending the Personal Status Law.

Nassif stated in a statement received by Sumaria News, "Did any of the specialists, judges, or one of our accredited authorities read the two papers that were distributed in the House of Representatives? Were they presented to the Shiite authorities in advance? Based on what was stated in the two papers, do the Shiites have a scientific academy or do we have authorities? And who will form the scientific academy? And if it is formed partisan, will people's lives be dependent on the academy? Is it logical to amend Article 2 based on codes that will be issued in the future after 6 months?"

She pointed out that “marriage by a notary is one point among many controversial points in this paper,” noting that “this marriage results in the existence of legitimate children but legally registered (without identity), and marriage by a notary does not require the spouses to undergo tests for immune or genetic diseases, meaning it helps in the spread of genetic diseases and deformities in addition to ([You must be registered and logged in to see this link.]), and in the event that the husband abandons the wife and gets rid of the proof, the doors will open for (murder under the pretext of washing away the shame).”

She asked, "Will the notary who will conduct the marriage contract in exchange for a sum of money take into account the waiting period, which is one of the sacred things to prevent the mixing of lineages?", explaining that "this law relates to the Iraqi family, and therefore we want clear texts that are not subject to multiple interpretations."

She stated that "these two papers ([You must be registered and logged in to see this link.]) are a collection of scattered ideas (scribbles) intended to implicate the legislative institution, and therefore we reject everything contained in them in its entirety and detail."
