The legal expert Tariq Harb said on Monday that Prime Minister-designate Adel Abdul-Mahdi can form his government with only ten ministers, stressing that it may not extend the 30-day deadline set by the Iraqi constitution to complete his mission.
He said in a statement today that the Constitution made the 30-day period for the budget of forming the ministry a period of fall that can not be extended by Parliament or any other as the President of the Republic assign another person to form the ministry if the candidate fails within thirty days from the date of commission on 2018/10/3, The end of 11/1 ends.
He added that "the Constitution did not specify the number of ministers in the new composition may be fewer than the current ministries and through that the Prime Minister-designate to ensure the formation of the new ministry by the time specified constitutionally, such as the number of ministers only ten ministers."
He added that the Constitution did not restrict the power of the incumbent to put a number of ministries in the ministries of one and the same agency and the selection of deputy prime minister, especially that the Constitution was lenient in granting confidence to the new ministry by requiring a majority vote of attendance only and not a majority more than half
He concluded by saying that the Constitution does not prevent the Prime Minister also has a number of ministries in addition to the presidency of the Council of Ministers acting.
