A few days after the vote to amend the Federal Court Law, where the road became clear for early elections to be held on time (the tenth of the tenth month of this year), the voices of members of Parliament began to rise regarding the mechanism for dissolving the Parliament. In Iraq, according to Article 64 of the Iraqi constitution, the President of the Republic issues a decree to hold elections within a period of 60 days after the end of the parliamentary session and extend it to 4 calendar years, which also means constitutionally that Parliament dissolves itself two months before the elections.
The October 2019 uprising imposed new entitlements represented by the overthrow of the previous government (the government of Adel Abdul Mahdi) and changing the election law in force in all previous parliamentary sessions in Iraq from the first parliamentary session in 2006 to the last session of 2018, as well as changing the High Commission. Independent Elections and the formation of a new government (the government of Mustafa Al-Kazemi), which was entrusted with the task of holding early elections.
This government announced an early date for holding elections in the sixth month of this year, but due to the continuing political disputes, in addition to organizational problems, the date was postponed to the tenth month. And since the node that could have prevented the elections from taking place at the new date with the possibility of continuing the parliamentary session to the next year (the fourth month of 2022), with the approval of the Federal Court Law by the majority despite the objections of many blocs due to the legal scholars, the new argument is the timing of dissolution Parliament.
While a large number of members of Parliament from different blocs see that dissolving Parliament is the authority of Parliament itself and with an absolute majority, legal experts believe that the authority to set the date of elections is the exclusive right of the President of the Republic.
In the context of this debate, there are those who see that all these attempts to dissolve Parliament one day before the elections are aimed not only at stripping the exclusive right of the President of the Republic as much as it means an effort to circumvent the attempts to hold the elections and postpone them to their periodic date next year, by fabricating The problem of dissolving Parliament a day before or 60 days ago as a result of a crisis of confidence between the government and parliament.
The government, after the parliament is dissolved, turns into a mere caretaker government until elections are held, and the objecting parliamentarians believe that if the parliament itself is dissolved, no one will remain monitoring the government, and thus it can postpone the elections under any pretext and continue its work without parliament.
In the opinion of former Deputy Prime Minister Bahaa Al-Araji, "calls to dissolve parliament on the eve of the elections" are nothing more than a word of truth that is intended as null.
Al-Araji added, in his tweet on the "Twitter" platform, that "what words, terms, and dates were put in the request, will turn the problem into a crisis that leads us to the unknown."
Representative in Parliament Basem Khashan, for his part, says that "the talk of political blocs about dissolving parliament is nothing but electoral propaganda. In fact, they do not want to dissolve parliament, but rather to complete its current session, so that their influence remains for a longer period."
Khashan added, "All political forces, not the majority, do not want early elections to take place, and their talk about supporting early elections is also part of their election propaganda in front of their audience and the angry Iraqi street, and that is why we do not expect that there will be early parliamentary elections, and we will not see the parliament dissolved except At the end of its current session. "
In addition, Farhad Alaa al-Din, head of the Iraqi Consultative Council, said in a statement to Asharq Al-Awsat, "The right to set the date of the elections is owned by the Iraqi constitution, particularly Article 64, by the President of the Republic, and it is an exclusive right that no one disputes."
Alaeddin added, "The call under which the President of the Republic issues a republican decree is to set a date for holding general elections in the country within a maximum period of 60 days after the parliament itself is dissolved."
