After nearly 3 months of relative calm in the country's political process, tension has returned to the atmosphere recently in the wake of the Federal Supreme Court's decision regarding the illegality of funds sent by the federal government to the region if the latter does not comply with the law and the constitution and hand over its oil production percentage to the region. Baghdad, while parliamentarians and observers confirm the legality and constitutionality of the federal decision; They demanded that the court not be involved in political conflicts, and that it rules in accordance with the constitution and the law and has nothing to do with understandings between political parties, parties and blocs.
A member of the House of Representatives, Raed al-Maliki, said in an interview with "Al-Sabah": "The Federal Court's decision is sound from a legal point of view, as it is not concerned with political agreements." It is contrary to the provisions of the Budget Law as well as the Financial Management Law, according to which the region is supposed to deliver its oil to the center in exchange for the government paying the percentage determined for it in the budget, but what happened is that the region did not deliver anything despite the official books and official correspondence, so the transfer of funds is contrary to the obligations between the two parties. .
And he indicated that "in the past year and until now, no budget has been legislated, and therefore the transfer of funds to the region is contrary to the law and the constitution." He explained that "the court's recent decision is legal and constitutional, but it intersects with agreements, alliances, and political understandings on the basis of which the government was formed, and that is not one of the court's problems." , stressing that "whoever accuses the court of politicization wants it to submit to his agreements and whims, and that will not be the case."
Al-Maliki noted "the necessity of approving the General Budget Law 2023 to stipulate in it the provisions regarding the financial relationship between the center and the region and the rights and obligations of the two parties, and that the funds be transferred in accordance with these provisions, especially since all governorates - including Basra - transfer all revenues to the federal government, and in return the the latter to transfer the allocations of Basra and others according to the budget law,” calling on the authorities and the government in the region to hand over its oil revenues determined according to the law in order to obtain its entitlements,” warning that “there should be no temporary agreements when approving the budget only, but rather there must be a radical solution Through the "Oil and Gas Law" legislation.
The deputy stressed that "the political agreements belong to those who signed them only, and that the people are not bound by them, and just as the southern governorates are committed to paying oil money and taxes, the region must do the same," noting that "the region always uses the salaries of employees whose numbers we do not know." Nor how much they charge."
In addition, the political analyst, Jassem Al-Gharabi, stated that "this matter has become a controversial issue among the components of the people," and he said in an interview with "Al-Sabah": "The text of the constitution and the law obliges the region to hand over all the revenues of its border crossings and airports, as well as 250,000 barrels per day to the federal government." In exchange for the center giving him 13 percent of the budget, the process has been in this situation for years, but it seems that this situation has become a political pressure card.
He added, "Today there is harmony between the Arab political blocs and the Kurdish side, which led to great understandings that reached the extent of the arrival of Masrour Barzani a week ago to Baghdad and his assertion that (the relations between the center and the region are good, that they support the Sudanese government, and that Iraq needs political stability), but Raising such issues will lead to the Kurdish side not being silent, and the Kurdish policy is strong and brilliant in the Iraqi political scene,” explaining that “there will be an abstention from the Kurds in voting on the budget, and there will also be a break between the coordination framework and the Kurdistan Democratic Party, like before before the inauguration of the President of the Republic and the formation of the government.” .
And he continued: "The Federal Court was involved in a legal issue, and the court does not judge except according to evidence and presumptions, so it ruled after making sure that the region did not deliver any sums to the center and that it did not deserve the money that was sent to it," noting that "the political scene can be confused at any moment." He used to say that “involving the Federal Court in such an issue is a mistake.”
