    Behalf of the people 
    of the Presidential Council
    Based on what passed the House of Representatives in accordance with the provisions of the first paragraph of Article sixty-first session of the Constitution. Due to the end of the legal period set forth in paragraph (V / a) of Article one hundred and thirty-eight of the Constitution. 
    issued the following law:
    No. (8) of the 2006
    Act
    and the Ministry of Labor and Social Affairs,
    the first chapter
    Definitions
    Article (1)

    The following definitions are intended meanings indicated opposite thereto:
    First: The Ministry: The Ministry of Labour and Social Affairs.
    Second: Minister: Minister of Labour and Social Affairs.
    Third: Undersecretary: Undersecretary of the Ministry of Labor and Social Affairs.
    Fourth: Council: Council of Labor and Social Affairs in the Ministry of Labour and Social Affairs.


    Chapter II
    Incorporation 
    Article (2)

    Establish a ministry called (Ministry of Labour and Social Affairs), represented by the Minister of Labour and Social Affairs or his nominee.


    Chapter III
       Tasks
    This article was amended by Law No. (77) for the year 2012
    Article (3) of this law is aimed at the following: -
    First: the embodiment of the humanitarian value of the work as a cornerstone in the economic and social development process and really considered as a national duty.
    Second: - Determine the minimum wage, including at least the upper limit of the tenth degree of peace grades of staff .
    Third: the deployment and deepen democratic practices between workers and departments, employers and trade union organization.
    Fourth, social security insurance for all workers.
    Fifth: deepen your occupational safety awareness in the workplace in order to ensure the protection factor of occupational diseases and accidents and work-related injuries and to ensure the maintenance of the machine and maintain production.
    Sixth: the deployment of professional awareness in order to ensure human resources development and rehabilitation according to the requirements of the labor market.
    Seventh: the granting of licenses to regulate the practice of maintenance work and raise the efficiency of their employees and increase their skills.
    Eighth: securing the welfare of the family and children of workers with disabilities.
    Ninth: providing equal employment opportunities for all capable of it.
    Tenth: the eradication of poverty through the provision of aid to the poor who are unable to work and unable rehabilitation professionally and socially through their support for the establishment of small productive projects.
    Eleventh: the care and rehabilitation of disabled events educationally and behaviorally to ensure their integration in the development process and the removal of the psychological and social influences that prevent this.

    Article (4)
    First: He is the supreme head of the ministry in charge of its policy and guidance issued by the Pashrafh and implement all the instructions and decisions and orders in everything related to the functions of the ministry and other technical, financial and administrative affairs within the provisions of the law.
    Second: The Minister may authorize some of his powers to any of Kelly and the ministry or any of its directors or employees to any of the staff of the ministry.

    Article -5- First: to be the ministry of three agents for the first work and the second for Social Affairs and the third administrative and legal affairs and be the agent responsible to the Minister on the implementation of the Ministry's policy and plan in respect of formations that the minister decides to relate to him, and has authorized some of his duties to any of the directors-general or to any of the Ministry's staff .
    Secondly, the two advisers to the ministry, who will implement the tasks entrusted to them by the Minister and are based provide advice with respect to the work of the ministry .

    Article (6)
    Constitutes the Ministry Council (Labour and Social Affairs) and consists of the following:
    First Minister. President
    Second: Agents ministry members .
    Third, a representative of the General Secretariat of the Council of Ministers rank of director general. Member
    Fourth: Representatives of the Ministry of Human Rights, Education, Health and Justice
    And internal, industry and women. Members
    Fifth: General Managers in the ministry. Members
    Sixth: The Director General of the National Center for Research and Studies. Member
    Seventh: The representative of the General Federation of Trade Unions. Member
    Eighth: a representative of the Iraqi Federation of Industries. Member
    Ninth: A representative of the Federation of Iraqi Chambers of Commerce. Member
    Tenth: three experienced and competent minister chosen from outside the ministry. Members

    Article (7)
    Solves Undersecretary replace older minister in the presidency of the Council in his absence.

    Article (8)
    Board meets once a month and at least every quorum meeting in the presence of at least two-thirds of its members, and decisions are taken by the majority of the members Aalhadharan number, and when the side that is likely equal voice with the President.

    Article (9)
    The Board shall include: -
    First, determine the general goals of the ministry's plan.
    Second, discuss the initial plan of the Ministry and approval and follow up their implementation.
    Third: discuss the annual budget of the Ministry and its owners and project approval.

    Fourth: the ratification of the final accounts of the ministry of the fund's capital and retired workers.
    Fifth: the study of the laws and regulations of the ministry projects.
    Sixth: discuss the annual report on the work of the ministry and make observations and recommendations in this regard.
    Seventh: The study presents everything to a statement by the Minister of opinion in it, and make what he sees in the would of proposals and recommendations.

    Article (10)
    The ministry formations consist of the following: -
    First: formations ministry center:
    A - Office of the Minister
    b - Office of the Inspector General
    © of the Legal Department 
    and (d) Administrative Department of Finance 
    (e) planning and follow-up department. 
    (f) Projects Department and follow-up. 
    (g) of the National Center for Research and Studies.

    Article (11)
    Runs each of the departments and centers stipulated in Article (10) of this law, an employee entitled general manager holds a university degree and at least in a preliminary experienced and competent and has the experience of not less than three years in the work of the department.

    Article (12)
    The minister's instructions specify configurations and functions of departments and centers and issued by the minister's office provided for in Article (10) of this law.

    Article (13)
    First, based in the Department of pension and social security for workers fund called (to ensure that retired workers fund) assets of the funds and revenue circle mentioned consists in the Ministry of Labour and Social Affairs. 
    Second: The Fund's corporate identity is represented by the Director General of the Department of pension and social Samman workers or his nominee.

    Article (14)
    First: Fund Board of Directors consists of the following runs:

    (H) a representative of the Iraqi Federation of Chambers of Commerce and a member of
    (I) Two experienced and competent members chosen by the minister
    Second, the Fund's Board of Directors meets once a month at least every quorum and the meeting in the presence of at least two-thirds of its members, and decisions are taken by a majority of the members present, and when equality is likely to side with him, who voted President of the Council.

    Third, the Fund's Board of Directors' Decisions subject except as stated in item (iv) of Article (15) of the Act to the Minister authentication.

    Article (15)

    The President of the Fund's Board of Directors as follows: -
    First, determine aspects of investment funds and fund revenues.
    Second, the adoption of the general budget of the Fund project.
    Third: Approval of the conclusion of contracts and commitments for the Fund in accordance with the law.
    Fourth, decide on the objections to the decisions of the Director of the Department of pension and social security for workers in accordance with
    The provisions of the Act and retirement security Ctmai number (39 * 1971).
    Fifth: accept donations and contributions from inside Iraq if either of the competent authorities outside Vtsthsal consent.

    Chapter IV
    Final Provisions
    Article (16)
    Repealed the Labour Law and Social Affairs No. (29) for the year 1987 and the decision of the Revolutionary Command Council (dissolved) No. (551) for the year 1987 and the decrees Republicans numbered (201) for the year 1987 (1364) for the year 1989 and the remaining regulations and instructions issued under the window as not contrary to the provisions of this law Until the release of what replaced or repealed.

    Article (17)
    Minister of Labour and Social Affairs to issue instructions to facilitate the implementation of the provisions of this law.

    Article (18)
    This law shall be the date of its publication in the Official Gazette.

    Article Written under Law No. (77) for the year 2012 the first amendment to the Law of the Ministry of Labour and Social Affairs Law
