Legal expert Mohammed al-Sharif, on Saturday, a major breach signed by the House of Representatives since 2010, calling for addressing the enactment of the law of the Union Council, pointing out that the continued lack of legislative authority is a threat to the constitutional system in Iraq.
Al-Sharif told Mawazine News that "the Iraqi constitution has created for each authority in Iraq components, the executive power consists of the President of the Republic and the Council of Ministers, and the judiciary consists of the Supreme Judicial Council, the Federal Supreme Court, the Federal Court of Cassation, the Public Prosecution and the Judicial Supervisory Authority."
He added, "This division also included the legislative authority, which created two components, namely the House of Representatives and the Council of the Union."
He pointed out that "all components of the authorities are currently working with the exception of the second component of the legislative authority, the Council of the Union has not been formed so far."
He pointed out that "Article (65) of the Constitution stipulates (a legislative council called the Council of the Union shall be established, which shall include representatives of the regions and governorates that are not organized in a region, and shall regulate its composition, the conditions of membership, its competencies and everything related thereto, by a law enacted by a majority. Two-thirds of the members of the House of Representatives). "
Sharif explained, "The most prominent competence of this Council is to ratify the legislation issued by the House of Representatives, which was the task of the Presidency Council for the period between (2006/2010), and that the Iraqi Constitution was required to form after the end of the first electoral cycle, ie after 2010."
"Ignoring the formation of this Legislative Council constitutes a clear violation of the Constitution, an infringement of the structure it has imposed on its authorities and a serious formal defect that should be avoided," he said.
He finds that "the most important reason to ignore the lack of support in the legislative authority is the fear of the House of Representatives for its powers and its desire to seize all the joints of the legislation, taking advantage of political silence about it," stressing that "the existence of bicameral legislature is an advanced experience in the democratic systems in the United States America, England and other developed countries. "
Sharif called, "the House of Representatives to pay attention to fill the shortage in the components of his authority to remove the accusation that he seizes the legislative power through the enactment of the law of the Union Council and address the serious imbalance in its structure, which poses a threat to the constitutional order in Iraq."
