    Federal Court: Judicial Council the right to propose laws and to conclude agreements

     Baghdad / term

    The Federal Supreme Court confirmed the legitimacy of the judiciary in the preparation of proposals for the federal judiciary laws, and the validity of the conclusion of judicial agreements with other judicial authorities in coordination with the executive branch.
    According to an official statement of the Court that " the Federal Supreme Court considered the appeal submitted to the paragraphs in the Judicial Council , the Supreme Law No. (45) for the year 2017, and the response to appeal because it is not based on the support of the Constitution."
    The statement continued that " the first challenge responded to the paragraph gave the right to eliminate the proposal of laws relating to the judiciary affairs projects, the court found that it does not violate the Constitution and consistent with the separation of powers laid down the principle in Article 47 and Article 87 thereof , similar to legislative power exercised this right in accordance with Article (60 / II) of the Constitution. "
    The statement pointed out that " the other appeal , which he has received the Federal Supreme Court for paragraph empowers the judiciary to hold judicial agreements and follow up its implementation in coordination with the Ministry of Justice."
    The Court explained that "this is consistent with the Constitution and the principle of separation of powers adopted in its provisions and also consistent with the provisions of Article (87) thereof."
    The statement noted that " the judiciary more knowledgeable in the field of its potential implementation of these judicial agreements with other judicial bodies, including in the field of judicial cooperation and the achievement of prompt justice and the development of judicial possibilities."
    The statement said that "otherwise we are in front of a case of interference in the affairs of the judiciary and its functions when other authorities shall carry out his duties, contrary to the principle of judicial independence and the separation of powers provided for in Articles (19 / I) and (47) and (87) of the Constitution" .
    The statement said that " the contested text unconstitutional judiciary ensure that the exercise of this authority in coordination with the executive authority represented by the Ministry of Justice to ensure aspects of international financial obligations of the State."
