Federal Court: The establishment of a parliamentary committee to nominate members of the Electoral Commission does not violate the Constitution

    11:05 - 12/11/2017

    Information / Baghdad ..
The Federal Supreme Court on Sunday issued a decision on the formation of a committee of the House of Representatives to nominate the members of the Independent High Electoral Commission, confirming that this does not contradict with the Constitution.
"The Federal Supreme Court held its session and considered the appeal against the unconstitutionality of article 3 (II) of Chapter III of the IHEC law and the demand to cancel it," said Ias Samuk, a spokesman in a statement.
He added that "the appeal focused on the establishment of a committee of the House of Representatives to nominate members of the Board of Commissioners on the grounds that this constitutes a violation of the provisions of the Iraqi Constitution," noting that "the Court found in its decision of (7/11/2017) No. (88 / Federal 2017) The committee formed by the House of Representatives, which has nominated the members of the Board of Commissioners, has been provided for in Article 9 (II) of the Independent Commission for Elections Law, and that its candidacy was in compliance with its obligations under the said law.
The Samouk said that "the appellant relied on the members of the Commission of the owners of special grades that need to be nominated by the Council of Ministers," noting that "the decision of the Court stated that this nomination does not intersect with the provisions of the Constitution; because the candidates are not owners of special grades or agents of the ministry, But enjoy their privileges without the degree mentioned, and therefore the court found that the lawsuit is not based on a bill of the Constitution decided to reply. Ending / 25
