Last Wednesday, the US war crimes tribunal returned the perpetrator of the Nisour Square massacre in Baghdad in 2007 to a former US security contractor, Blackwater, to a US jury.
Nicholas A. Slatten, 34, was first convicted by a federal jury in October 2014 when he stood with three Blackwater guards to commit an incident that deeply dismayed the accountability of US security forces during the war in Iraq.
But in August the US Court of Appeals ordered a new trial against Slatin, saying he should have been tried separately from his accomplice, not Slaten, who launched the first two rounds of bullets that led members of the Blackwater convoy to brutally shoot machine guns and bombers Bombs in the densely populated Nisour Square in Baghdad, killing 31 civilians.
On Monday, in the closing arguments of the five-week retrial, US prosecutors said Slaten acted out of deep hatred for all Iraqis, not just the insurgents, and deliberately incited the September 16, 2007 massacre in a failed security operation. Prosecutors told the panel that Slatan was acting on the basis of "a misleading idea of retribution" in the 2001 terrorist attacks.
The prosecutor, Fernando Campamwur-Sanchez, said Slatin used a sniper rifle to fire a lethal bullet at the driver of the 19-year-old white car who stopped near the traffic barrier stopped by the Blackwater Ravine 23 convoy, causing the attack that killed women, Investigators from the Justice Ministry found the remains of children.
Prosecutors said Slatin and others first celebrated shooting with high casualties. A member of Blackwater testified that Kia's driver had been killed and Ahmed Haitham Ahmed al-Rubaie, a medical student who was driving with his mother, was killed.
Other guards did not agree with what they described as unwarranted killings, according to witness testimony. Prosecutors said there was no evidence of gunmen at the scene.
Salatin's lawyers argued that their client acted in self-defense in a war zone and fired after others reported firing from an AK-47 and mistakenly believed that a Kia car was in the car.
As in the first trial of Slatin, his defense relied heavily on investigators' comments in the days following the shooting of one guard, Paul, 38, who said that Slatin did not fire first until the Kia came to the convoy.
In the 2014 trial, Slaw and two other guards were convicted and found guilty of 13 counts of unintentional murder and 17 counts of attempted murder by mistake. The appeals court, which ordered a new trial against Slatin, also said the other three - who had been sentenced to 30 years in jail - should be tried again.
Slatin's lawyers said two Iraqi traffic police officers confirmed the statements, which said the first shots came from a tank gun from the top of Salten's armored vehicle under Salo's command. Which put two slings inside, and fired through a side aperture.
Jimmy Watson, the commander of the four-car convoy, who was sitting near Slatin, also retracted his first strong testimony as a key government witness on the witness platform that he had not heard Salatin fire first.
The fire in Baghdad sparked outrage against America abroad and made the name "Blackwater" synonymous with an irresponsible US military force.
The information also included testimony from other witnesses, former colleagues who described Slatin as Iraqis "animals" "their lives are not worth anything" and witnessed past incidents in which unprovoked fire was fired at benign targets.
Prosecutors said Sloo's confession that he was the first to believe that the convoy was under attack was not clearly clear, part of a series of lies to avoid accountability for a civil massacre.
They said his claim that Kia's car approached high speed contradicted nine eyewitnesses, six of whom said they did not move until their driver was shot.
