US media reported, on Wednesday, that the US judiciary had approved the return of an Iraqi from Al-Qaeda who killed two police officers in the city of Fallujah in Anbar province 15 years ago and fled to the United States.
The Associated Press reported that a US judge approved a request submitted by the Iraqi government earlier to extradite the owner of a driving school in Arizona, accused of participating in the killing of two police officers for al-Qaeda.
Under the ruling, the US judge entrusted the decision to deport Ali Youssef Ahmed Al-Nouri to the federal government for a decision.
The agency quoted the US Department of Justice as saying that it had no record of handing over anyone to Iraq under a US-Iraq treaty that was signed decades ago.
If Al-Nouri is handed over to the Iraqi government, he will be the first to be deported from the United States and sent to his home country under this treaty.
The judge concluded that there was a probable cause for Al-Nouri's participation in the murder, but the man denies any involvement or that he is a member of a terrorist group.
And the Attorney General of Arizona requested last April to agree to extradite Al-Nouri to the judicial authorities in his home country, and said that the evidence presented by the Iraqi authorities against him was sufficient.
Prosecutors asserted that witnesses saw al-Nuri at the crime scene in 2006, and that another person claimed that he was part of the al-Qaeda group and implicated Ahmed in it.
In return, Al-Nouri's lawyers asked the judge not to extradite their client, claiming that this is not permitted under the provisions of the US-Iraq treaty that prohibits extradition for crimes of a political nature.
Al-Nouri came to the United States in 2009 and obtained American citizenship in 2015.
