Alsumaria News - Politics

The expert on the Iraqi constitution, Hassan Al-Yasiri, confirmed today, Friday, that the caretaker government is a finished government that has nothing in the matter but to run daily matters and maintain security, and it is by virtue of the resigned, and therefore the resigned does not resign!

Al-Yasiri said in a clarification received byAlsumaria newsBelieving in national and moral responsibility, I offer the following:
    - We have repeatedly pointed out that the caretaker government is a finished government that has nothing to do but manage daily affairs and maintain security, and it is by virtue of its resignation, and that the resigned does not resign! .

The constitution defines the provisions of the three authorities with full powers; Because it is concerned with regulating the origin, not the exception. For example, it regulates the provisions of the constitutional government with full powers, not the caretaker government, except in limited and numbered cases, and these counted cases are mostly mentioned exclusively; Because it appears contrary to the original, as in the case of the resignation or dismissal of the constitutional government, as the constitution provides for its transformation into a caretaker government, and the consequent call for new elections, and so on.

Based on the foregoing, the caretaker government may not and has no right to resort to Article (81) of the Constitution, which talks about the vacancy of the position of the Prime Minister and the call for new elections; As there is no vacancy for the position as required by this article in the caretaker government, it is essentially a finished government, and that vacancy is only achieved with the constitutional government with full powers. If the caretaker prime minister is absent or is unable to perform his duties, his deputy will take his place, and there is no way to implement Article (81) at all.

There is no doubt that the statement that it is permissible to resort to the provisions of vacancy under the aforementioned article in the caretaker government leads to the fact that any head of a caretaker government can, immediately after holding the elections and announcing the winning bloc, announce - if the election result is not in his interest, for example - that his position is vacant, in order to Other new elections are resorted to in order to change the result and confiscate the victory of the other bloc with the stroke of a pen; This is a very confused and misleading statement, and there is no sane person on earth who would say it; Therefore, the provisions of that vacancy do not apply to the caretaker government at all, and it is not permissible for it to resort to it and work with it!

    - The government should consult some legal advisors - only illustrious ones - in the three authorities before it involves itself and the country in a job that I am almost certain will put it under the authority of the law in the future.

    - I advise the caretaker government to abide by the constitution - before politics - and not to repeat its violation as it was violated in several positions and decisions, and to carry out its duties in maintaining security and protecting the Iraqi people from any internal and external threat, and to repudiate that under any pretext - emptiness, neutrality or Towards that - it would be tantamount to evading responsibility on the one hand, and perjury of the constitutional oath that would result in future constitutional and legal accountability, on the other hand, and this is a case that does not fall within the statute of limitations.
