He added, "The sale of cars is subject to these laws," noting that "any defect or damage to the rights of others, especially consumer rights, is subject to a specific law."

The legal expert revealed that there are three cases in this regard, and said, “If the buyer buys from a branch of an agent for a [You must be registered and logged in to see this link.] or [You must be registered and logged in to see this link.], for example, and the agent fails, then the injured party has the right to file a lawsuit against the company and not against the agent, because the company is responsible for the actions of its agent.”

He added, "There is a second case in which a car is purchased from a large Iraqi company and obtains the approval of the Ministry of Commerce to sell the car, but it agrees with international companies. If it fails to deliver, this company will be held accountable."

He continued, "The third case is that there are offices that sell cars on installments and he did not agree with an international company and did not obtain approval from the Ministry of Commerce. His punishment is of three types: he returns the amount, then compensates, and he is punished with a prison sentence of up to five years."

Al-Sufi stressed the necessity for “the citizen to be aware and go to a serious office and file a complaint.”

Regarding the warranty and after-sales maintenance, Al-Sufi said, “The citizen must preserve his rights when purchasing a car, and when signing the contract, he must read it before signing and read the warranty.”

He pointed out that "the problem is that there is no legal culture and the citizen does not ask," adding that "the legal penalty if companies fail to comply can be brought against them in the Court of First Instance and they are required to pay compensation, and a lawsuit can be brought against any company and there are complaints that have been made, because the Consumer Protection Law in [You must be registered and logged in to see this link.] protects the citizen."

Citizens complained about what they described as “chaos” in the sale of cars by some companies in [You must be registered and logged in to see this link.], stressing that they are thinking of profit and that there is no supervision, control or punishment for these companies.
