[size=52]Statement of the Iraqi Communist Workers’ Party on the “Personal Status Law Amendment” Project[/size]
[size=45]Once again, the reactionary, medieval current calling for “amending” the Personal Status Law is being forced to retreat. Since taking power two decades ago, the ruling political Islam movements in Iraq have sought to impose retreats on the gains achieved by the feminist, liberation, and equality movements in Iraq, primarily the socialist forces, over many decades. Their aforementioned call and decision received a severe blow and widespread public condemnation from the forces of progress and civilization, primarily women and liberationists.
Due to the intensity of these parties’ panic, they sent the draft resolution to parliament suddenly and without resorting to the usual procedures and paths for decisions, and sought to surprise parliament with this step so that it would vote on it while the parties opposing it would be helpless and blind. Not only that, but in a step that disregards the simplest human values, some bargained with the parties opposing this decision, and blackmailed them by linking the approval of the “general amnesty” law to voting in favor of this infamous decision. It is despicable and vile to tie up the lives of tens of thousands of prisoners, most of whom have been languishing in prisons for years, surrounded by hideous death sentences due to malicious charges, secret informants, forced confessions, violence, sectarian hatred, the elimination of opponents, etc.!! It is clear that they have no honorable and recognized way to advance their agenda that is hostile to women, children, and the civility of society except through these dirty methods.
The amendments they are talking about are not amendments. They are a demolition of the law. They are a regression of society for more than six decades! These “amendments” make women deformed beings, purely sexual vessels for men, devoid of rights and freedoms, deprived of inheritance and ownership, and vulnerable to the backward and unjust jurisprudential interpretations of men who truly hate women. Women are deprived of the right to child custody, the marriage (or rape) of minors, and other values of bygone eras, values before civilization, civilization, and human rights. Amendments that condition the granting of alimony to women on meeting the sexual needs of men under the rule: “There is sex, there is alimony,” otherwise no!
By giving unscrupulous sheikhs and clerics free rein in matters of marriage, divorce, custody, and all the daily affairs of a society of more than 40 million people, these “amendments” undermine citizenship, the law, the courts, and the state, even at the bare minimum of these concepts. They are amendments that establish a state of sheikhs and mullahs outside the state.
These issues are the agenda of political Islam and reflect its true nature. Therefore, any expectation or expectation from these forces is a blatant illusion. These forces have nothing to do with improving people’s conditions, providing services, advancing health and education, or ensuring the comfort of a society of two million thirsty for prosperity and freedom. Not only that, but they are also immersed in corruption, crime, looting of society’s wealth, spreading chaos and lawlessness, and trading with all reactionary forces, whether tribal or sectarian.
The parliament presidency has removed this decision from its agenda. However, this sword remains hanging over the heads of society. It is likely that, in a process of bargaining, blackmail, “arm-twisting”, baseness and other practices that are an integral part of their political and social nature, these groups will impose this draft law on society. Therefore, forces and ranks must be united in order to never allow these forces the opportunity to implement their agenda that is hostile to women, children and the civility of society.
The Workers' Communist Party calls on all forces of freedom and equality to continue their struggle and confront these forces and their obsolete medieval programs. It emphasizes once again that the parliament and the government do not enjoy any legality or authority to pass any law or decision. They are tools imposed on society by violence, force and militias. They are tools that the overwhelming majority did not give their voice to and did not recognize in the first place. The manipulation of society's fate must be ended by sweeping away the current political process as a whole, through a mass uprising that ends this authority, its elections, its parliament and its laws that are hostile to the overwhelming majority of society, and establishes a popular authority based on the direct will of the masses.
