Zebari considers the decision to exclude him politically and a new round to elect a president of the republic in early March

Baghdad / Tamim Al-Hassan
It is expected that the recent judicial decision to exclude Hoshyar Zebari, the most prominent candidate for the presidency, will enter the country in a new crisis that will prolong the period of the “constitutional vacuum.”
He considered Zebari, after being expelled from the race for the presidency, the decision of the judiciary is politically motivated.
Accordingly, it is assumed that the session to choose the president of the republic, instead of the one that failed more than a week ago, will be repeated at the beginning of next March.
Only two months remain until the end of the previous parliamentary term, which was replaced by the decision of the "early" elections that took place 4 months ago, while the steps to form a new government are faltering.
On the night of the judicial decision, leaks had indicated that discussions between the two major Kurdish parties, the Kurdistan Democratic Party and the Patriotic Union, were hampering the position of the President of the Republic.
On the other hand, the negotiations of the Shiite forces are still on hold, after the decision of the leader of the Sadrist movement, Muqtada al-Sadr, to “freeze” the talks more than a week ago.
more complex
Manaf al-Moussawi, a researcher in political affairs, points out that the political crisis, which has been going on for more than a month, is on its way to "complication."
Al-Moussawi added, in a call yesterday with (Al-Mada), that: "Removing Hoshyar Zebari from the competition to run for the presidency of the republic will enter it into a long constitutional void whose end is unknown."
Yesterday, Sunday, the Federal Court decided that Zebari's nomination for the presidency was illegal, according to a document issued by the latter.
Zebari said in a press conference yesterday, that the decision to exclude him was "politicised", and that the judiciary acquitted him of the charges against him.
And the court decided last week to stop the procedures for the nomination of Zebari, who came on a list of 25 candidates announced by parliament at the end of last month, after a number of deputies filed a corruption case against him.
Decision night
These developments came after a crucial night in which the two major Kurdish parties, the Democratic Party and the Patriotic Union, fought negotiations over the presidential crisis.
He was nominated from the news that the two parties did not reach an agreement, and the National Union came out hours before the decision of the judiciary to confirm its candidate, who is Barham Salih, the current President of the Republic.
On the other hand, the Democrat insisted on Zebari. A party official, Arafat Karam, said, "President Masoud Barzani's candidate for the post of President of the Republic of Iraq is Hoshyar Zebari, and he will remain so."
Karam added, in statements carried by Kurdish media, that "Zebari is not only the Kurdistan Democratic Party's candidate, but he is also the candidate of the Sadrists and the Alliance of Sovereignty."
And he added, "Barham Salih puts obstacles in the way of the parliament session so that he remains in office."
In a later development of events, the Federal Court decided that Barham Salih would continue in his position as President of the Republic until a new president was chosen, according to the official agency.
new boss
There is talk in some political corridors that it is likely that the Kurdistan Democratic Party, to which Zebari belongs, has nominated another person for the position.
Commenting on the selection of an alternative to the post, Zebari said that it is "the prerogative of the Democratic Party," denying the existence of an alternative candidate for him so far.
Last Friday, the door for the second nomination for the position of President of the Republic was closed, which lasted for three days, according to what was announced by the presidency of the new parliament.
Legal Adviser Ahmed Al-Abadi confirms that the federal decision "will not affect" the rest of the candidates who submitted the second nomination.
The parliament presidency, in a move that sparked controversy over its legality, announced last Tuesday, opening the door for candidacy for the post of President of the Republic after the end of the month period without electing a president.
Al-Abadi said in a call yesterday with (Al-Mada): “The new constitutional terms will start from the moment the candidacy door is opened again,” which means that the second presidential election session will be in early March.
Secondly, Article 72 of the Constitution stipulates that: “The President of the Republic continues to exercise his duties until after the end of the elections for the new House of Representatives and its meeting, provided that a new President of the Republic is elected within thirty days from the date of its first session.”
The last text, which prompted a deputy to file an appeal due to the expiry of the month period from the beginning of the session to elect a President of the Republic, and it is not possible to open the door for nomination again.
The parties in the Sovereignty Alliance, which includes the alliances of progress and determination, had confirmed the night of the judicial decision, that there were 170 deputies who would vote for Zebari.
According to Article 70 of the Constitution, two-thirds of Parliament members (220) are required to elect the President of the Republic, and those present must be in the same last number, according to the latest interpretation of the Federal Court.
So far, the tripartite coalition that includes the Sadrist movement, the Sovereignty Alliance and the Democratic Party has not been able to achieve two-thirds of the seats to pass the new president.
On the other hand, the other side, the Shiite forces known as the "coordinating framework", do not have this number to pass Barham Salih, the candidate of the last group.
This transformed the coordination framework team with the National Union into what has become known as the “blocking third” in Parliament, which must have at least 110 seats, a number that may not have been achieved so far.
Manaf al-Moussawi, a researcher in political affairs, says that "the two parties do not have the ability to move the situation and the crisis is escalating."
