Integrity announces the results of a questionnaire on bribery in tax departments in Baghdad and the governorates

{Local: Al-Furat News} The Federal Integrity Commission recommended that the Ministry of Finance issue a binding directive to the departments of the General Tax Authority regarding the reversal of tax deposits for general citizens, “carrying over the amounts of the deposits and restricting them as revenue to the public treasury.” Based on the recommendations of the committee composed of the General Secretariat of the Council of Ministers.
Integrity urged finding an appropriate mechanism to address the issue of deposits, especially those who did not keep the original receipts, as the tax departments keep copies and data from those receipts in their records, after noting the lack of compliance by some departments with the directives of the General Secretariat, as the auditor who keeps previous deposits is still obligated to He has original receipts for additional payments; In order to obtain service from these departments, it urged the preparation of a draft of a new tax law that is compatible with the changes that occurred in the state’s economic and investment policies. To be an alternative to the current law, and to set a timetable; To implement electronic automation systems, and propose legislation and laws to address deficiencies or cases where the applicable law is devoid of legal provisions.
The Department of Relations with Non-Governmental Organizations at the Authority indicated in its report, a copy of which was sent to the office of the Prime Minister, that in order to measure the impact of the General Authority’s procedures for taxes and its response to the results, observations and recommendations of the previous questionnaire, it carried out through the Authority’s central team, its supporting teams and the teams comprising In the investigation directorates and offices in Baghdad and the governorates, with (323) field visits to the tax departments over a period of three months, during which the opinions of (8,369) auditors in (44) departments in Baghdad and the governorates were sought.
The results of the analysis of the questionnaire measuring perceptions of bribery in Baghdad and the governorates indicated that the general rate of bribery abuse (perception) in (18) departments in Baghdad reached (31.8%), and the Companies Department at the headquarters of the General Tax Authority recorded the highest rate of bribery abuse (49.2). %), followed by the sales tax (40.9%), then the direct withholding department at the authority’s headquarters (40%), while the tax departments in Abu Ghraib, Mahmoudiya, and Al-Rusafa recorded the lowest engagement rate, amounting to (13.8%, 24.5%, and 25%). 1%), respectively, while the results showed that the corporate department at the headquarters of the General Tax Authority is considered the worst among Baghdad departments, according to most of the answers to the questionnaire questions and field meetings.
As for the governorates, the Karma Tax Department in Anbar Governorate came first with the highest percentage in measuring bribe payment (Idrak) and reached (51.6%), then Karbala (41.7%), followed by Basra with (38.9%), while the Karbala Tax recorded a percentage of (38.9%). Mosul - the right coast has the lowest percentage of bribery (1.8%), followed by Diyala and Dhi Qar taxes with (3.2% and 3.3%), respectively.
The report pointed out that the high level of bribery weakens citizens’ confidence in state institutions and authorities, and undermines their prestige, and that bureaucratic procedures in the work of tax departments create an appropriate environment for blackmailing and bargaining with the auditor. Additionally, the departments do not seek to develop work mechanisms and employees’ skills, apply quality and governance standards, and subject them to periodic evaluation. In addition to the adoption of a paper system in collecting financial amounts, the failure to benefit from modern electronic systems in collecting funds and fees, and the failure to implement modern automation systems, despite the promises of officials of the General Authority for Taxes to address this in previous periods, all contribute to creating an environment conducive to corruption.
He stressed the importance of clarifying the procedures related to reviewing real estate departments and estimating rent allowance, by setting controls apart from the personal judgments of the members of the estimation committees, as their members have broad authority to estimate the amount of tax due to the state. Which exposes the auditor to blackmail and bargaining to pay a bribe in exchange for reducing the tax amount, in addition to addressing the issue of resolving ambiguity regarding the similarity of names, which is dealt with using jurisprudence and methods that differ from one department to another according to the conviction of the director or the competent employee.
The report suggested activating the role of the Ministry of Finance’s regulatory agencies. To follow up on the performance of the employees of the General Tax Authority, after the results of the questionnaire revealed that (65%) of the percentage of bribe payments was made directly from the auditor to the employee, in addition to shortening the procedures required to complete the transaction and eliminating redundant episodes, as (58%) of the auditors reported paying the bribe. To speed up completion, he also suggested speeding up the completion of the tax number for each taxpayer to eliminate joints exploited by corrupt people, while noting that the recommendations of the questionnaire report prepared in 2021 should not be taken seriously, and that there should be no change in the work procedures followed.
He identified a number of negatives, represented by the presence of large numbers of brokers and brokers in the departments who play the role of mediator between the auditor and the employee, and these have priority in completing transactions.
