Baghdad - Mawazine News
The Communications and Media Commission revealed the details of the crisis that occurred with Korek Communications Company, while indicating that the amount of debt owed by the company is $800 million.
The head of the Media and Communications Commission, Ali Al-Muayyad, said in a televised statement, “In fact, the framework for the work of mobile phone companies comes within the framework of licensing contracts between them and the Iraqi state, which is represented by the Media and Communications Commission,” noting that “these contracts indicate four main resources in dealing with and framing the relationship between the Commission and the company.” “Working in this sector includes the legal, financial, technical and regulatory aspects.”
He added, “All companies must adhere to these four resources,” pointing out that “the Korek Company issue is old and not new or new, but rather since the beginning of the companies’ work and licensing contracts in 2007, and there is a difference of viewpoints between Korek Company and the Authority and the companies operating in the sector, which is that The new licensee, Korek Company, which came after 2007, should have privileges over other companies.”
He pointed out that "Korek believes that there is a losing company that left the market, which is Iraqna, and this company should have given its subscriber base and all its balance, towers and infrastructure to the profitable company, which is Korek Telkom," stressing that "this issue did not take this course in 2007, while the reality was during That year, there was a higher ministerial committee headed by the Ministry of Finance at the time and membership of the Ministries of Planning, Science and Technology, and other ministries, which went to Amman and under the supervision of a British company that prepared the licensing contracts and presented the companies, and an auction was held for the mobile phone issue. He continued: “The contracts stipulate that the losing company in the auction
must They reach an understanding with the winning company, and if they do not obtain an understanding and agreement between them, they can move to other companies, and this is what happened according to the documents available to us,” noting that “the negotiations between Korek and Iraqna Company did not lead to anything and they did not reach an agreement, and therefore Iraqna Company went to reach an understanding with Zain Company and it happened.” A financial understanding between them and the transfer and transfer of towers and infrastructure to Zain Company.”
He pointed out that “mobile phone companies operate in accordance with license contracts,” noting that “companies are required to adhere to the terms of the legal, financial, and technical license.”
He added, "The Korek Company crisis began in 2007 after it demanded concessions," noting that "Iraqna Company negotiated with Korek and did not reach an agreement with it."
He stated that "Korek Company filed lawsuits in 2013 against the Media Authority and Zain Company," stressing that "Korek Company lost the compensation lawsuit at first instance, appeal, and cassation."
He continued, "Korok Company claimed that it had debts to the Communications and Media Commission," stressing the need for Korok Company to pay its financial obligations to the state.
He pointed out that "the Commission resorted to the Supreme Judicial Council for the purpose of putting an end to the pending files," explaining that "9 judges from the Court of Cassation supported the 2013 decision in favor of the Commission."
He explained that “the cassation decision overturned the 2015 decision that Korek Company adhered to,” noting that “the cassation decision rejected the request for a corrective decision submitted by Korek Company.”
He pointed out that "there are legal measures against telecommunications companies and there is no targeting of a specific party," stressing that "the authority dismissed the former managing director of Korek Company."
He continued: “The law allows the authority to cut off interconnection with mobile phone companies,” stressing that the number of subscribers to Korok Company is 5 million and 200 thousand subscribers. He pointed out that “
Korok Company refused to have servers and switchboards in Baghdad for the purpose of security protection,” explaining that “there are Security indicators of the intelligence agency on Korek Company’s activities.”
He went on to say: “Korek Company did not respond to all citizens’ complaints.” End 29
